Book excerpt: In its evidence Government set out its intent to explore options for greater autonomy and financial freedoms for individual governing governors. The current NOMS systems are, by design, very centrally controlled. It is clear that every establishment has different circumstances and greater delegation could help with management of the different issues faced by different prisons. Delegation of some aspects of reward has the potential to be an important component of a more devolved approach overall, and to the benefit of our remit group. But there are risks if such delegation is introduced into a system that is not prepared for it, and is currently under stress. It is essential first to articulate the strategy and objectives for such delegation, develop the necessary change management processes and identify training requirements. Moving to the recommendations this year for pay, the report starts with the Fair and Sustainable pay structures, which is seen as the basis for the future. Fair and Sustainable was agreed by the parties when introduced and, while there are clearly issues with recruitment in some establishments, it currently appears to allow NOMS to recruit the numbers of staff they need nationally

It contains recommendations for the pay levels for governors, other operational managers, prison officers and support grades. It recommends that, with effect from 1 January 2002, there is a general increase in basic pay which represents an annual increase of 4.8 per cent, by raising existing rates by 6 per cent for a 15 month period. This will bring the annual award date into line with other pay review bodies. Other recommendations include the continuation of performance-related equity share arrangements for governors and other operational managers.

Book excerpt: This book interrogates Conservative government penal policy for adult and young adult offenders in England and Wales between 2015 and 2021. Government penal policy is shown to have been often ineffective and costly, and to have revived efforts to push the system towards a disastrous combination of austerity, outsourcing and punishment that has exacerbated the penal crisis. This investigation has meant touching on topical debates dealing with the impact of resource scarcity on offenders' experiences of the penal system, the impact of an increasing emphasis on punishment on offenders’ sense of justice and fairness, the balance struck between infection control and offender welfare during the government handling of the SARS-CoV-2 pandemic and why successive Conservative governments have intransigently pursued a penal policy that has proved crisis-exacerbating. The overall conclusion reached is that penal policy is too important to be left to governments alone and needs to be recalibrated by a one-off inquiry, complemented by an on-going advisory body capable of requiring governments to ‘explain or change’. The book is distinctive in that it provides a critical review of penal policy change, whist combining this with insights derived from the sociological analysis of penal trends.

Book excerpt: This book shows how the overall impact of the penal policy agenda of the Coalition Government 2010-2015 has not led to the intended 'rehabilitation revolution', but austerity, outsourcing and punishment, designated here as 'punitive managerialism'. divThe policy of austerity has led to significant budget cuts in legal aid and court services which threaten justice. It has also led to staffing reductions and overcrowding in the prison system which threaten order and have undermined more positive work with prisoners. The outsourcing of prison and community-based offender services is based on untried method with uncertain results. The shift in orientation towards punishment is regrettable because it is essentially negative. The book notes that this move to punitive managerialism is located in the broader trend towards neo-liberalism. It concludes by attempting to articulate the parameters of an affordable and emotionally satisfying yet humane and rational penal policy.>

Book excerpt: Designing a fair, effective and acceptable regime that will reconcile public interest and the public’s need for an uninterrupted flow of essential services on the one hand, while maintaining the freedom of collective bargaining on the other, is an ever more difficult public policy challenge. This book, the first detailed comparative analysis of existing legal and practical approaches across a spectrum of key national jurisdictions, provides a structured and insightful overview of the law and practice of regulating strikes in essential services. As such it can be of great value for public policy debate and the enhancement of national law in the field. The editors have assembled experts from fourteen countries who describe and analyse their respective country’s experience with strikes in essential services and the legislative and judicial as well as informal approaches towards regulating and intervening in such strikes. Departing from legal theory with systematic comparative ‘law in action’ research, the contributors offer innumerable valuable insights into a broad array of issues and topics as the following: – mechanisms aiming at compensating employees for encroaching on their collective bargaining rights; – public accountability and responsible management of public finance; – role of international conventions; – effects of globalization and advances in technology; – privatization, outsourcing and the decline of unions and workers’ solidarity; – growing popular intolerance towards strikes in essential services; – effect of human rights-related court decisions; – convergence and divergence among contemporary legal regimes in defining and approaching strikes in essential services; – dispute process design and dispute resolution processes (mediation, conciliation and arbitration); and – substantive and procedural restrictions on the right to organize, bargain collectively and strike. The country reports are preceded by a detailed analysis of the inherent normative policy dilemma and a conceptual framework for designing and evaluating models of regulation. The concluding chapter presents a comparative overview of the insights gained. With its comparative perspective on one of the most sensitive areas of industrial relations and labour law, and its contextually relevant options for strategic choice and public policy debate, this incomparable volume will be welcomed by labour lawyers, legislators, policy makers, judicial bodies and researchers in the field of collective labour relations and fundamental human rights of workers on the national as well as international level.

Available in PDF, EPUB and Kindle. Book excerpt: How do young women negotiate their identity in the shadow of a criminal past? What expectations can these women have and what constraints do they face in embracing change and reform? In this new book, Gilly Sharpe returns to the group of women interviewed in her bestselling book Offending Girls, to ask these questions and more. Building on wide-ranging interviews with young adult women who have experienced a highly punitive climate in both youth justice and welfare policy, this book analyses their vivid personal accounts of stigmatisation and devaluation as former lawbreakers, welfare claimants and mothers, and examines their gendered transitions from youth criminalisation into adulthood. Women, Stigma, and Desistance from Crime exposes how stigma, which is rooted in structural inequality and thrives in societies with deep economic and social divisions, devalues working-class and marginalised women and diminishes their lives. It offers a unique analysis of how criminal stigma is shaped by class-based condescension, welfare inaction and school-based disciplinary punishment, and reveals how stigma is reproduced over time across education, welfare, and penal institutions. Meticulously researched and the first study to examine how the lives of young women previously enmeshed in the youth justice system unfold as they transition to adulthood, this book will be of interest to scholars and students of criminology and criminal justice, sociology, social work, social policy, gender and youth studies, and to practitioners and policy-makers in these fields.

Book excerpt: This book explores how the themes and insights of official Catholic Social Teaching (CST) and broader Catholic social thought might illuminate, and be illuminated by, a deeper engagement with the context of prisons. What resources might Catholic social thought bring to pastoral work in prisons? And what might listening to the prison context bring to Catholic social thought? The volume includes constructive proposals for the relationship between CST and prison ministry, as well as critical questions about the role and shortcomings of prisons, CST, and chaplaincy. It contains contributions by scholars and practitioners of theology, criminology, and prison chaplaincy from the UK, US, and Ireland, and reflects on the inextricable relationship of social action and pastoral care in the work of prison ministry.

Book excerpt: Although prison can present a critical opportunity to engage with offenders through interventions and programming, reoffending rates among those released from prison remain stubbornly high. Sport can be a means through which to engage with even the most challenging and complex individuals caught up in a cycle of offending and imprisonment, by offering an alternative means of excitement and risk taking to that gained through engaging in offending behaviour, or by providing an alternative social network and access to positive role models. This is the first book to explore the role of sport in prisons and its subsequent impact on rehabilitation and behavioural change. The book draws on research literature on the beneficial role of sport in community settings and on prison cultures and regimes, across disciplines including criminology, psychology, sociology and sport studies, as well as original qualitative and quantitative data gathered from research in prisons. It unpacks the meanings that prisoners and staff attach to sport participation and interventions in order to understand how to promote behavioural change through sport most effectively, while identifying and tackling the key emerging issues and challenges. Sport in Prison is essential reading for any advanced student, researcher, policy-maker or professional working in the criminal justice system with an interest in prisons, offending behaviour, rehabilitation, sport development, or the wider social significance of sport.
