Bush signed into law the Prison Rape Elimination Act (PREA) of 2003, marking the first time the U.S. government has passed a law to address sexual assault behind bars. Under this Act, the National Institute of Corrections (NIC) is specifically mandated to provide information and assistance to the corrections field in the areas of prevention, investigation, and punishment. Through a cooperative agreement with (NIC), The Moss Group, Inc. conducted a series of facility focus groups with prison and jail staff concerning their views on sexual assault. These interviews were designed to collect detailed descriptions of staff perspectives on inmate-on-inmate sexual violence in the correctional environment, including knowledge of, and responses to, sexual violence. Although most respondents discussed male inmate-oninmate sexual assault, it is important to note that PREA applies to all offenders and staff working with offenders. This focus group was designed to focus primarily on male inmate-on-inmate sexual assault in order to assist NIC to explore this topic in greater detail for the purpose of development of training strategies. While an issue of staff sexual misconduct was mainly mentioned in a discussion about female facilities, staff sexual misconduct happens in all facilities and applies to all staff and offenders.

Book excerpt: With the adoption of the Prison Rape Elimination Act in 2003, institutions around the country began developing policies and procedures related to the detection, prevention, and elimination of sexual victimization in prison. The research, however, was in its infancy and little was known regarding the context, severity, and impact of victimization on a variety of outcomes. This study explored the impact of emotional, physical, and/or sexual victimization on inmates who were returning to the community. Few, if any studies have explored the additive effect victimization may have on an already difficult transition period for offenders. The study hypothesized that victimization intensified mental health problems and criminal behavior. Recently released prisoners from twenty-two halfway houses and prisons in Ohio, were selected for this study. Standardized instruments were utilized to assess the inmates; psychological status in various areas, including but not limited to post-traumatic cognitions, depression, anxiety, social support, coping, and criminality. The final analysis compared recidivism rates between those who report having been victimized and those who have reported not being victimization. The findings from this study have implications for policy and practice, For example, by examining patterns of victimization, administrators may be able to develop strategies towards identifying those at risk for victimization even in an inmate who has not come forward, thereby facilitating early, needed interventions. Early detection and intervention could significantly reduce the negative impact of victimization on inmates. Additionally, this study provides support for expanding the types of services provided to incarcerated individuals, both in the institution and after release. It is important that practitioners identify and comprehend the impact that victimization can have on reentry, short- and long-term.

Because prisoners face restrictions on liberty and autonomy, have limited privacy, and often receive inadequate health care, they require specific protections when involved in research, particularly in today's correctional settings. Given these issues, the Department of Health and Human Services' Office for Human Research Protections commissioned the Institute of Medicine to review the ethical considerations regarding research involving prisoners. The resulting analysis contained in this book, Ethical Considerations for Research Involving Prisoners, emphasizes five broad actions to provide prisoners involved in research with critically important protections: • expand the definition of "prisoner"; • ensure universally and consistently applied standards of protection; • shift from a category-based to a risk-benefit approach to research review; • update the ethical framework to include collaborative responsibility; and • enhance systematic oversight of research involving prisoners.
