Book excerpt: "The Most Important Treatise on Criminal Law Produced by American Legal Scholarship" First published to great acclaim in 1947, Hall's General Principles of Criminal Law is one of the undisputed classics in its field. It provides more than a broad overview. Drawing on his expertise in jurisprudence and the work of the legal realists, it analyzes the principles that comprise criminal activity with an emphasis on its creation and definition by officials. This process is explored in the chapters on criminology, criminal theory and penal theory and, in more specific terms, the chapters on legality, mens rea, harm, causation, punishment, strict liability, ignorance and mistake, necessity and coercion, mental disease, intoxication and criminal attempt. "For many years, our standard work on criminal law has been Bishop's. First published in 1856, Bishop's is the only American book in the field that has conspicuously influenced our criminal law. (...) When Jerome Hall's, General Principles of Criminal Law (1947) appeared, it represented the first significant effort to articulate the principles of criminal law since Bishop's era. Hall's work may, in fact, represent the most important treatise on criminal law produced by American legal scholarship." --Fred Cohen, Journal of Legal Education 16 (1963-64) 260.

Book excerpt: Criminal Law: Historical, Ethical, and Moral Foundations, 3rd edition, blends legal and moral reasoning in the examination of crimes and explores the history relating to jurisprudence and roots of criminal law. In order to fully grasp criminal law concepts, students must go beyond mere rote memorization of the penal code and endeavor to understand where the laws originate from and how they have developed. This book fosters discussions of controversial issues and delivers abridged case law decisions that target the essence of appellate rulings. Grounded in the Model Penal Code, making the text national in scope, this volume examines: Why the criminal codes originated, and the moral, religious, spiritual, and human influences that led to our present system How crimes are described in the modern criminal justice model The two essential elements necessary for criminal culpability: actus reus (the act committed or omitted) and mens rea (the mind and intent of the actor) Offenses against the body resulting in death, including murder, manslaughter, felony murder, and negligent homicide Non-terminal criminal conduct against the body, including robbery, kidnapping, false imprisonment, assault, and hate crimes Sexual assault, rape, necrophilia, incest, and child molestation Property offenses, such as larceny/theft, bribery, forgery, and embezzlement Crimes against the home, including burglary, trespassing, arson, and vandalism The book also examines controversial public morality issues such as prostitution, drug legalization, obscenity, and pornography. The final two chapters discuss inchoate offenses, where the criminal act has not been completed, and various criminal defenses, such as legal insanity, entrapment, coercion, self-defense, and mistake of fact or law. Important keywords introduce each chapter, and discussion questions and suggested readings appear at the end of each chapter, prompting lively debate and further inquiry into a fascinating subject area that continues to evolve. Updated to include the latest developments in the law, this book is appropriate for undergraduate students in criminal law and related courses.

Book excerpt: This paperback text, which is briefer than most of its competitors, presents the basic concepts and principles of criminal law. The authors present the prevailing positions on specific issues, without going into lengthy explanations of majority and minority positions. This clarity of presentation allows them to include material not often found in other criminal law texts, such as white collar crime, victimless crime, political crime, and non- political crimes against the government.

Book excerpt: Criminal Law: Cases, Materials, and Problems, Third Edition, focuses on basic principles of Anglo-American criminal law and is designed for use in an introductory course in Criminal Law, either in a law school or an undergraduate program in Criminal Justice, taught by teachers who use the case method of instruction. The book includes cases and statutes from various jurisdictions, as well as excerpts from the Model Penal Code. In addition, the author has strategically placed problems throughout the book so students can apply the law set forth in the cases and statutes to new fact situations, thereby allowing them to test their knowledge and reinforce their understanding of the relevant legal principles. The goal of the book is twofold: first, to help students gain an understanding of the general principles of Anglo-American criminal law; second, to aid students to develop their skills in case analysis, statutory interpretation, synthesis of cases, and problem-solving. David S. Rudstein is Professor of Law and Co-Director of the Program in Criminal Litigation at Chicago-Kent College of Law, Illinois Institute of Technology, where he has been teaching Criminal Law to first-semester students since 1973. Professor Rudstein received a J.D., cum laude, from Northwestern University, and an LL.M. from the University of Illinois. After receiving his law degrees he served for a year as law clerk to Justice Walter V. Schaefer of the Supreme Court of Illinois. Professor Rudstein is a member of the American Bar Association and the Chicago Council of Lawyers. In addition to having edited casebooks on criminal law and criminal procedure, he has written a book on the double jeopardy provision of the United States Constitution, is co-author of a three-volume treatise entitled Criminal Constitutional Law, and has published numerous law review articles on various aspects of constitutional criminal procedure.

From a preeminent authorship team, Criminal Law and its Processes: Cases and Materials, Tenth Edition, continues in the tradition of its best-selling predecessors by providing students not only with a cohesive policy framework through which they can understand and examine the use of criminal laws as a means for social control but also analytic tools to understand and apply important criminal law doctrines. Instead of presenting the elements of various crimes in a disjointed fashion, Criminal Law and its Processes: Cases and Materials focuses on having students develop a nuanced understanding of the underlying principles, rules, and policy rationales that inform all criminal laws. A cases-and-notes pedagogy along with scholarly excerpts, questions, and notes, provides students with a rich foundation for not only the academic examination of criminal laws but also the application of the law to real-world scenarios. Features: Retains prior edition’s principal cases and Notes and Questions approach to explain and probe fundamental concepts. Notes updated to incorporate contemporary cases and recent news touching on criminal law. Inclusion of additional preeminent cases in the field of criminal law, including: Yates v. United States, 135 S. Ct. 1074, (Supreme Court application of common statutory interpretation techniques and the rule of lenity) Rosamond v. United States, 134 S. Ct. 1240, (Supreme Court examination of accomplice liability) Perry v. Florida (examination of the agreement requirement for conspiracy through the lens of a Florida sexual battery offense).
