Book excerpt: Radio broadcasters need not negotiate in a free market with the copyright holders of sound recordings to be able to broadcast those sound recordings on radio. This is unlike television broadcasters, who must negotiate with movie copyright owners before they can broadcast the movies. In some instances (the United States, for instance) radio broadcasters have no obligations whatsoever to the copyright owners of the sound recording (as opposed to the copyright owners of the music). In other instances the radio broadcasters must pay a performance right fee for broadcasting the sound recordings, but these fees are determined by governmental or judicial agencies and need not bear any relationship to what negotiated rates would be. The reason for the weaker copyright protection on sound recordings relative to movies appears to be that radio broadcasters have argued, and it is generally accepted, that radio play benefits record sales and thus there is less need for radio broadcasters to purchase the rights to broadcast the sound recording. This impact of radio play on record sales is commonly referred to as a "symbiotic" relationship between these two industries and is often mentioned by radio broadcasters as a reason for keeping rates low, at hearings to set copyright payments. Yet there appears to be no systematic examination of this relationship. In this paper I present evidence indicating that radio play does not appear to benefit overall record sales. There are obvious implications for copyright since the lack of a symbiotic relationship implies a higher expected negotiated payment for the copyright on sound recordings. I also examine, by way of comparison, television's negative impact on the movie industry.

In addition the Passage of the Performance Rights Act would harmonize U.S. copyright law with those of other countries, benefiting both U.S. recording artists and the U.S. economy. Unsuccessful arguments made for lack of performance rights for over-the-air broadcasts: promotional value for the recording artist and the public interest obligations put on broadcast platforms. Neither argument is persuasive. If one party invests in and creates a resource with value to the public, governments should not let others appropriate that resource for their own commercial gain just by showing that the creator might therefore derive some incidental benefit. While airplay may indeed have some promotional benefit to the recording artist, the recording artist also confers benefits to the radio broadcasters by producing songs that people want to hear. Therefore, one party should not possess property rights while the other does not. Moreover, the artist now has multiple channels to exploit for promotional purposes, bringing to question the actual promotional value of the broadcast medium. As for the argument that over-the-air broadcasters should be exempt from performance rights because they are saddled with public interest obligations that other platforms are not, such burden of public interest obligations should cause policymakers to re-think broadcast regulation, not punish performers. Lack of public performance rights puts the U.S. at odds with laws in other countries. As a result, U.S. artists do not receive performance royalties abroad in reciprocation of the failure of the U.S. to compensate foreign artists. The lack of a general public-performance right for sound recordings unquestionably constitutes a net loss to U.S. artists, the U.S. music industry, the U.S. economy, and U.S. credibility as an advocate of reasoned, harmonized, and effect copyright policy.

Book excerpt: When a terrestrial radio station plays a song during its over-the-air broadcast, the artists and their record labels receive no compensation for the sound recording right. Yet radio's digital competitors -- including streaming services and satellite radio -- do pay performance royalties to performers and their labels for the sound recording. Terrestrial radio's cost-advantage is not the result of marketplace deals or competitive forces, but from a statutory preference granted to radio broadcasters. Legislation aimed at leveling the playing field has been strongly resisted by broadcasters based on the claim that radio provides a promotional effect, or free advertising, for record labels and performers. In this BULLETIN, we demonstrate that any promotional effect is fully internalized in a marketplace bargain between the music and radio industries. As such, a promotional effect provides no basis for federal law to mandate the free use of music by the radio broadcast industry.

However, under current law, terrestrial radio broadcasters who play copyrighted music need only compensate songwriters for the performance of their musical compositions and not the holders of the copyright in the sound recording. Sound recording copyright holders assert that there is no justifiable reason for the copyright law to treat sound recordings differently from other categories of performable copyrighted works. They maintain that recording artists deserve to be fairly compensated by broadcast radio for public performance of their works just as songwriters and music publishers are currently being paid for such activity.
