Book excerpt: Siendo uno de los temas más relevantes del actual Derecho de Familia, la protección de los derecho de los niños, niñas y adolescentes es uno de los menos desarrollados por la literatura jurídica nacional, cuestión paradójica si consideramos la inmensa carga que han impuesto a nuestro país los instrumentos internacionales suscritos por Chile. Ahora bien, dentro del proceso de reforma a la administración de justicia familiar se crearon una serie de procedimientos para las distintas materias contenidas en el artículo 8° de la Ley 19.968, procedimientos entre los que se encuentra el de aplicación judicial de las medidas de protección. En un primer momento parecía que el procedimiento proteccional instaurado por la Ley No 19.968 había cubierto todas las expectativas que la reforma tuvo en consideración respecto del resguardo de la amenaza o vulneración de los derechos del niño, niña y adolescente, y que las falencias proteccionales se dan a nivel de las instituciones que materializaban la ejecución de las sentencias que imponen las medidas más que a la normativa propiamente tal, cuestión que está lejos de ser cierta. Los que tienen la oportunidad de tramitar con regularidad en sede familiar ven que el problema proteccional no parte de la aplicación o ejecución de las medidas de protección por las instituciones vinculadas a los tribunales, sino más bien, del conjunto de políticas, instituciones y normas para tales fines . De ahí, que a modo de comprender los límites de la función jurisdiccional en el Sistema de Garantías y de Protección Integral de los Derechos de la Niñez y Adolescencia el autor plantea un análisis armónico y coherente de las Leyes Nos 19.968, 21.302 y 21.430 para cumplir con tales fines. Como se ha hecho costumbre en los trabajos que ha desarrollado el autor, los temas consideran el aporte de especializados autores del área, opiniones, pensamientos y contribuciones que se fueron integrando a los distintos títulos buscando mantener una estructura más o menos sistemática para la enseñanza, aprendizaje y posterior aplicación de las materias vistas. Ahora bien, innovando en este punto, se requirió además de la colaboración de la psicóloga Bárbara Alejandra Alvarado Cottenie, quien desde su especialidad, ha sido la responsable de completar, corregir y actualizar los distintos aspectos vinculados a las principales formas de maltrato, cuestión que de seguro podrán apreciar en los títulos respectivos. Por último, debemos señalar, que la obra busca proporcionar un trabajo más o menos sistemático de los temas vistos, cuestión que podrán comprobar una vez que hayan recorrido su contenido, el cual esperamos sea de su completo agrado.
