Book excerpt: L'accord de coopération semble être affecté dans notre ordre juridique d'un handicap majeur: de par sa nature particulière, cette convention par laquelle des contractants s'engagent à poursuivre ensemble la réalisation d'un objectif commun souffre en effet de son inévitable inadaptation. Or, l' article 1134 du Code civil semblant fermer toute porte à une révision des conventions n' ayant pas été prévue dans le contrat originaire, ou acceptée postérieurement par l'ensemble des parties, il pouvait paraître que hors ces deux derniers cas de figure, rien ne saurait obliger l'un des coopérants à adapter sa prestation au but poursuivi. Pareille solution ne satisfait pourtant pas. A la recherche de ce que devrait être le régime des accords de coopération face à l'inadaptation, recherche obligeant à une prise de position sur le rôle à attribuer à l'analyse économique du droit, une constatation s'impose : le respect de la fonction de ces contrats exige parfois que l' on prescrive leur modification, dans le respect de l'intérêt des parties et, le cas échéant, des objectifs d'utilité sociale assignés à ces accords par le droit de la concurrence. Cette nécessité de conférer à ces contrats un certain caractère évolutif démontrée, restait à vérifier l'accueil qu'est aujourd'hui susceptible de lui faire notre droit positif. Malgré les apparences, il s'avère que ce dernier consacre déjà, d'une façon générale, l'adaptabilité des conventions. A ce constat, la recherche d'un fondement approprié pour imposer une obligation d'adaptation des accords de coopération s'en trouve encouragée d'un double point de vue: d'abord, une telle obligation ne viendra pas en rupture complète avec le droit existant, mais sera au contraire en parfaite harmonie avec celui-ci ; ensuite, préciser les fondements possibles de l'obligation et en marquer les limites, c'est également mieux maîtriser les contrats évolutifs, dont la réalité s'affirme finalement incontournable dans notre ordre juridique.

After much hesitation, the International Law Commission codified the state of necessity as a circumstance precluding wrongfulness in the field of State responsibility. This study aims to demonstrate that it is a much wider mechanism, essential to international law and strictly connected to its own characteristics. It performs the function of limiting the substantial obligations of States in case of the realization of a fact condition – a situation of necessity – in order to avert an excessive social cost, born out of law implementation. It always works through a balance of conflicting interests. Only when a social cost cannot be avoided, the state of necessity, under the features of a mitigating circumstance, enters the field of secondary obligations relating to international responsibility.

Book excerpt: This work is a comparative study of domestic implementation of Security Council mandatory sanctions taken under Article 41, Chapter VII of the UN Charter, including the establishment of the two international criminal tribunals, the ICTY and ICTR, and recent resolutions on the combating of the financing of terrorism. The book examines implementation in 16 select States in Europe, America, Asia, the Middle East and Africa, underlining also the particular problems arising from sanctions implementation by the European Union, by a permanently neutral and former non-Member State - Switzerland - and by States confronted with special economic problems within the meaning of Article 50 of the UN Charter. Three interrelated themes are addressed. The first, of a theoretical nature, concerns the question of whether implementation of Security Council resolutions, particularly where perceived to be in fulfilment of community objectives, poses problems which are in some way distinct from those raised by the implementation of other conventional international law obligations, thereby shedding a different light on the traditional relationship between international and municipal law. The second concerns the effectiveness of the decisions of the Security Council viewed from the perspective of the effective mise en oeuvre of these decisions in national law. The third theme concerns the legitimacy of Security Council resolutions as seen from the viewpoint of domestic legal systems, that is the extent to which Security Council decisions encroach on internationally or constitutionally protected individual rights and the potential role played by domestic courts in reviewing the decisions of the Security Council.The latter has assumed particular importance in the framework of the combating of the financing of terrorism. This work, which brings together the research results of 29 academics and experts, is the second publication within the framework of a project on Security Council sanctions carried out under the auspices of the Graduate Institute of International Studies. The first, which looked at a broad set of issues, was entitled "United Nations Sanctions and International Law" and was published by Kluwer Law International in 2001.
