Book excerpt: International shipping is of great importance for the transport of a great many types of cargo. Substances and products considered dangerous constitute almost 50% of all the payload. It is obvious that stringent regulations are required in order to minimize the risks of accidents. These regulations, which are derived from good practice and which are based on research, have been adopted by a great number of countries. However, emergencies do occur in spite of all precautions. Such emergencies require fast and adequate response in order to confine the consequences for man and his environment to a minimum. Emergency response has political, legal, financial and technical aspects. This makes decision making extremely difficult. The papers carefully prepared and assembled in this book present an up-to-date picture of today's achievements, knowledge and difficulties that are being faced. It was the intention of Oilchem Recovery Denmark and TNO to bring the wide scatter of aspects together in a joined perspective. We also intended to spread the information on latest developments among the many people who are involved in combating calamities and in particular in decision making. Finally, we hope that this conference may help all of us to come to a safer transport of chemicals and a better aquatic environment. We thank all the authors for their magnificent contribution.
Download or read book Pollution at Sea written by Baris Soyer and published by Taylor & Francis. This book was released on 2013-06-07 with total page 418 pages. Available in PDF, EPUB and Kindle. Book excerpt: A sharp, informed and thoroughly practical guide to contemporary and developing issues relating to sea pollution, prepared by leading academics and practitioners with everyday hands-on experience. Pollution at Sea focuses on a number of the vital private law issues – compensation, insurance, contract and tort – thrown up by contemporary developments in the law of pollution. The book also intends to offer a critical analysis on emerging public law concepts, such as the legal position of seafarers from the perspective of criminal law in cases of pollution and the impact of port state control as a pollution control mechanism. Pollution at Sea is divided into three parts: 1. Private Law Liability Regimes 2. Rights and Liabilities of Particular Parties 3. The Impact of Public Law on the Actors Concerned In part 1; various liability regimes are dissected, including those which have been under the spotlight in recent years. This section has particular international appeal, and many of the regimes discussed are based at least in part on international conventions, agreements or practices. In part 2; the impact of pollution at sea on third parties is considered, with respect to the legal position of parties that might be perused either by the victims of pollution incidents or in some cases by the parties liable by way of a recourse action. Finally in part 3; recent relevant developments, particularly in the realm of public law are covered.

Book Synopsis Vessel-Source Pollution and Coastal State Jurisdiction by : Erik Franckx
Download or read book Vessel-Source Pollution and Coastal State Jurisdiction written by Erik Franckx and published by BRILL. This book was released on 2021-09-06 with total page 427 pages. Available in PDF, EPUB and Kindle. Book excerpt: After seven years of work, the Committee on Coastal State Jurisdiction Relating to Marine Pollution of the International Law Association concluded its work by submitting its final report for discussion at the occasion of the London conference, July 25-29, 2000. This book brings together the different official reports submitted by this Committee at the 1996 Helsinki, 1998 Taipei, and 2000 London conferences, as well as some preparatory documents necessary for the correct understanding of these just-mentioned reports. The Committee concentrated its work on vessel-source pollution and made it a central objective of its work to produce results which could facilitate the interpretation of the 1982 United Nations Convention on the Law of the Sea. During its work, it became moreover apparent that an accurate assessment of state practice proved more than once problematic either because of problems relating to interpretation or simply because the basic information was missing. For that reason, the present book contains a special section where different members of the Committee prepared detailed national reports, written according to a strict outline worked out for this purpose, in order to shed additional light on the specific issues dealt with by the Committee. Together with the conclusions arrived at by the Committee these additional national reports represent a valuable statement of the present-day status iuris questionis.
