Book excerpt: Kenya is one of about 42 African countries which have enacted framework environmental laws. 14 January 2000 was the Date of Commencement of the Environment Management and Co-ordination Act (EMCA) after its adoption in December 1999 and receipt of Presidential Assent on 6 January 2000. From that date, all sectoral laws were expected to be reviewed or amended to ensure consistency with the requirements of EMCA. Under Section 148 of EMCA: "Any written law, in force immediately before the coming into force of this Act, relating to the management of the environment shall have effect subject to modification as may be necessary to give effect to this Act, and where the provisions of any such law conflict with any provisions of this Act, the provisions of this Act shall prevail". This book is an appraisal of the extent to which this provision has been implemented. It critically analyses environmental law in Kenya with a view to identifying the convergences and divergences between select sectoral laws and EMCA. The ultimate objective is to support internal harmonization of the corpus of environmental law in Kenya.

Book excerpt: A broad literature in natural resource management establishes how community-based institutions can manage some natural resources well, but this literature has not fully considered the social context of management institutions and their history of interactions with state law. The dissertation applies a legal pluralism framework and engages the debate about whether legal pluralism -- the multiplicity and overlap of local authorities in resource management -- leads to (dis)incentives to conserve. In specific the dissertation asks: what factors or problem areas of legal pluralism might be associated with more (or less) sustainable land, forest, and water management? This question is explored in four micro cases of legal pluralism in Meru, Kenya. Each micro case focuses on a different set of institutions and a different sustainability outcome. The case studies are: chiefs and erosion control, elders' councils and tree-cutting regulations, land committees and decisions to set aside hilltop forest reserves, and resource user groups and watershed maintenance. The case studies highlight different social institutions and their interaction with the Kenyan state from the time of British colonialism to the present day. Each of the cases involves miraa farmers -- their natural resource decisions, their compliance with state law, and their participation in non-state institutions and stakeholder forums. Miraa farming provides an interesting context for this study because miraa is a legal but often criticized stimulant crop that has been ignored (or threatened) by state law. It is thus open to community-level management under customary authorities. A major conclusion of the research is that greater semi-autonomy and greater allowances for systems of moral rewards in social institutions can, under the right conditions, greatly augment the state's sustainability policies, despite introducing complexity and multiplicity in resource management. A second major conclusion is that it is not necessary for each resource to have one owner or a single dominant set of rules. The history of attempts to fit resources to the "one owner" model has been one of unnecessary antagonism between state law and social institutions at the neighborhood level.

Book excerpt: The problems related to the process of industrialisation such as biodiversity depletion, climate change and a worsening of health and living conditions, especially but not only in developing countries, intensify. Therefore, there is an increasing need to search for integrated solutions to make development more sustainable. The United Nations has acknowledged the problem and approved the “2030 Agenda for Sustainable Development”. On 1st January 2016, the 17 Sustainable Development Goals (SDGs) of the Agenda officially came into force. These goals cover the three dimensions of sustainable development: economic growth, social inclusion and environmental protection. The Encyclopedia of the UN Sustainable Development Goals comprehensively addresses the SDGs in an integrated way. It encompasses 17 volumes, each one devoted to one of the 17 SDGs. This volume addresses SDG 15, namely "Protect, restore and promote sustainable use of terrestrial ecosystems, sustainably manage forests, combat desertification, and halt and reverse land degradation and halt biodiversity loss" and contains the description of a range of terms, which allow a better understanding and foster knowledge. Book excerpt: Community-based adaptation (CBA) to climate change is based on local priorities, needs, knowledge and capacities. Early CBA initiatives were generally implemented by non-government organisations (NGOs), and operated primarily at the local level. Many used ‘bottom-up’ participatory processes to identify the climate change problem and appropriate responses. Small localised stand-alone initiatives are insufficient to address the scale of challenges climate change will bring, however. The causes of vulnerability - such as market or service access, or good governance - also often operate beyond the project level. Larger organisations and national governments have therefore started to implement broader CBA programmes, which provide opportunities to scale up responses and integrate CBA into higher levels of policy and planning. This book shows that it is possible for CBA to remain centred on local priorities, but not necessarily limited to work implemented at the local level. Some chapters address the issue of mainstreaming CBA into government policy and planning processes or into city or sectoral level plans (e.g. on agriculture). Others look at how gender and children’s issues should be mainstreamed into adaptation planning itself, and others describe how tools can be applied, and finance delivered for effective mainstreaming. This book was published as a special issue of Climate and Development.

Book excerpt: As community involvement in natural forest management expands and matures, the need to lodge the rights and obligations of both state and community in workable and legally binding institutional frameworks becomes more pressing. This is particularly so where power and authority are being redistributed. This publication looks specifically at Tanzania, where forest-local communities are beginning to be designated as the management authority of particular woodlands and, in some cases, even their owners. Positive results are giving considerable support to community-based management as the forest management strategy of choice. Implementation has of necessity also prompted a search for accessible mechanisms through which community authority may be embedded legally. The author argues that, in this respect, Tanzania has an advantage over many sub-Saharan African states in the unusual manner of legal identity granted to rural communities, and in supporting administrative and land laws which provide for village-based control over natural resource management. Specific elements explored include the fact that rural villages in Tanzania are recognised as a formal level of government, endowed thereby with certain rights and obligations; that the rural village may attain legal corporate status allowing it, inter alia, to own and manage property in ways accountable in a court of law; and that property law provides for a modern, statutory version of communal tenure, within the bounds and accountability of a private legal person. Wily provides a step-by-step guide to the ways in which a forest-adjacent community may secure custodianship over a local natural forest, whether it be an already gazetted Forest Reserve or public land forest, and be held accountable for sound conservationary management.
