Book excerpt: Les petites et moyennes entreprises représentent 99,9 % des entreprises, 52 % de l'emploi salarié, 38 % du chiffre d'affaires et 49 % de la valeur ajoutée ; néanmoins leur participation dans la commande publique est loin d'être en adéquation avec ces valeurs. Cette considération a commencé à être véritablemnt prise en compte, à partir de la réforme du 1er août 2006 portant création du code des marchés publiques, mais s'est considérablement accélérée depuis le début de la crise économique, dans un but de développement de l'économie locale et de soutien à l'emploi. Cependant les réformes successives visant à favoriser l'obtention des marchés par les PME, se sont heurtées aux principes de la commande publique, la différence de situation existant entre les PME et les grandes entreprises, n'étant pas suffsante pour justifier une différence de traitement. C'est donc tout naturellement que s'est construite progressivement une volonté de mettre sur un pied d'égalité ces deux entités, en simplifiant l'accès des PME à la commande publique ; cette nouvelle dynamique aux antipodes de la direction initialement choisie ayant globalement porté ses fruits. Cependant dans une logique totalement inverse, le pouvoir réglementaire a introduit une politique d'économie d'échelle favorisant la massification et la gobalisation de l'achat publique, qui, certes demeure freinée, dans une certaine mesure par les principes de la commande publique et le principe de l'allotissement des marchés, mais est plus efficaces dans sa mise en oeuvre que les mesures initiées pour promouvoir l'accès des PME aux marchés.
