Book excerpt: ABSTRACT: As a new nation, the United States lacked the long naval traditions of the other powers of the time, particularly Great Britain. When Congress created a naval force in 1794, the country had to rely on its first officers to form the traditions of the service and lay the foundations of the American Navy. These first officers bequeathed to their country the naval force that would eventually challenge the mighty Royal Navy in the War of 1812. However, officers alone were not responsible for the maturation of the Navy. Civilian officials, notably the Secretary of the Navy, also played a major role in the development of an American maritime force. These two components did not always interact harmoniously. Captains, used to the total autonomy that command at sea in an era of starkly limited communication created, often had difficulty subordinating themselves to their civilian superiors. During the first three decades of the Navy's existence, successive Secretaries of the Navy would gradually increase their authority over their officers, establishing the traditions of civilian control over the military that had long been a part of land warfare. This thesis explores the process whereby the question of ultimate authority over the Navy was settled, beginning with the creation of the navy and culminating in the creation of the Board of Naval Commissioners following the War of 1812.

Rather than focus on the well-known frigate duels and fleet engagements, Thomas Sheppard emphasizes the overlooked story of the institutional formation of the Navy. Sheppard looks at civilian control of the military, and how this concept evolved in the early American republic. For naval officers obsessed with honor and reputation, being willing to put themselves in harm's way was never a problem, but they were far less enthusiastic about taking orders from a civilian Secretary of the Navy. Accustomed to giving orders and receiving absolute obedience at sea, captains were quick to engage in blatantly insubordinate behavior towards their superiors in Washington. The civilian government did not always discourage such thinking. The new American nation needed leaders who were zealous for their honor and quick to engage in heroic acts on behalf of their nation. The most troublesome officers could also be the most effective during the Revolution and the Quasi and Barbary Wars. First Secretary of the Navy Benjamin Stoddert tolerated insubordination from "spirited" officers who secured respect for the American republic from European powers. However, by the end of the War of 1812, the culture of the Navy's officer corps had grown considerably when it came to civil-military strains. A new generation of naval officers, far more attuned to duty and subordination, had risen to prominence, and Stoddert's successors increasingly demanded recognition of civilian supremacy from the officer corps. Although the creation of the Board of Navy Commissioners in 1815 gave the officer corps a greater role in managing the Navy, by that time the authority of the Secretary of the Navy--as an extension of the president--was firmly entrenched.

Book excerpt: This book argues that the effectiveness of the state apparatus is one of the crucial variables determining human rights conditions, and that state weakness and failure is responsible for much of the human rights abuses we see today. Weak states are unable to control their own agents or to police abuses by private actors, resulting in less accountability and more abuse. By contrast, stronger states have greater capacities to protect human rights; even strong authoritarian states tend to have better human rights conditions than weak ones. The first two chapters of the book develop the theoretical connections between international law, sovereignty, states and rights, and the consequences of state failure for these relationships. The empirical chapters (Chapters 3-6) test the validity of these theoretical claims, employing a multi-method approach that combines quantitative and qualitative methods. Englehart uses case studies of Afghanistan, Burma/Myanmar and the Indian state of Bihar to analyze types and patterns of state failure, based on analysis of NGO reports, archival research, primary and secondary texts, and interviews and field research. Examining what happens to human rights when states fail, the book concludes with implications for scholars and activists concerned with human rights. This book will be of great use to scholars of international relations, comparative politics, human rights law and state sovereignty.
