Book excerpt: Depuis l'entrée en vigueur de la loi n°2005-102 du 11 février 2005 « pour l'égalité des chances et des droits, la participation et la citoyenneté des personnes handicapées », le droit français connaît une définition du handicap qui, après une maturation progressive, dessine des perspectives et impose à la société des exigences inédites. Cette loi, qui insiste notamment sur l'accessibilité du cadre bâti et des informations, a été suivie de la réforme de la protection des majeurs le 5 mars 2007. Cette dernière apporte des modifications relatives aux mesures de protection, afin que soit préservée l'autonomie des majeurs, et recentre la procédure d'ouverture sur le volet médical.L'autonomie de la personne handicapée sera centrée sur les droits de la personne par rapport à son corps (consentement à l'acte médical, sexualité, stérilisation...) et par rapport à l'exercice des droits de la personnalité (droit de fonder une famille, gestion patrimoniale, emploi...). Le but est de montrer qu'une excessive protection peut entraver l'épanouissement personnel du handicapé, alors qu'une liberté absolue pourrait susciter des abus de faiblesse. Il est alors nécessaire de démontrer l'idée selon laquelle autonomie et protection ne sont pas deux notions forcément opposées et qu'une protection adaptée préserve l'autonomie de la personne handicapée mentale.Entre protection et émancipation, les objectifs sur ce thème répondent au souci de permettre aux personnes d'exercer leurs droits, de développer un « projet de vie » tout en tenant compte de leur vulnérabilité. Ils se déclinent en termes de solutions et/ou d'améliorations, d'information et de formation, pour les individus directement concernés, pour ceux qui les accompagnent (proches et professionnels) et pour l'institution qui les héberge.
