Avec 1683 détenus de plus de 60 ans, 411 septuagénaires, 27 octogénaires et 3 nonagénaires la population âgée n'est plus une population marginale en prison. Le vieillissement est le fruit d'une double évolution: vieillissement des entrants et allongement des peines. Une étude réalisée au sein des deux centres de détention de Toul et Ecrouves (54), a permis de rencontrer 35 détenus. Les 2/3 étaient incarcérés pour des crimes et délits à caractère sexuel. 71,4% de ces détenus avaient des peines supérieures à10 ans, 25,7 % des peines comprises entre 5 et 10 ans et 1 détenu était condamné à perpétuité. L'évaluation sanitaire de ces détenus, l'étude de leur environnement socio-familial et de la littérature a permis de révéler les problèmes secondaires à l'âge et à la détention. Les détenus âgés rencontrent des problèmes spécifiques à la détention: isolement, vieillissement accéléré, perte de la notion de temps, impact sensoriel, effets psychologiques et maladies psychosomatiques, violences. De même la présence de détenus âgés en prison, le vieillissement, l'existence de pathologies chroniques et dégénératives posent des problèmes aux différents établissements pénitentiaires: handicaps, dépendance soulevant des problèmes d'hygiène, de transferts et de déplacements. Une réflexion sur la fin de vie s'impose également.

Les personnes incarcérées sont plus vulnérables et plus exposées aux phénomènes de vieillissement que la population générale. L'objectif principal de notre étude était d'évaluer l'autonomie des personnes âgées de plus de 55 ans incarcérées à la maison d'arrêt d'Arras et au centre de détention de Bapaume. Les objectifs secondaires étaient de décrire les facteurs associés à la perte d'autonomie, les aides mises en place et le nombre de demandes de suspension de peine pour raison médicale. Méthode : Nous avons mené une étude descriptive transversale prospective monocentrique, au sein des établissements pénitentiaires rattachés au centre hospitalier d'Arras. Au cours des mois de juin et juillet 2018, les participants ont répondu à un questionnaire qui reprenait la grille AGGIR et collectait d'autres renseignements, notamment médicaux. Résultats : Cent quarante-quatre patients ont participé à l'étude, parmi eux 20,8% (n=30) étaient considérés en perte d'autonomie avec un GIR ≤ 4. Les principales difficultés retrouvées concernaient la marche, les transferts et le ménage en cellule. Ce vieillissement a provoqué l'émergence de de la dépendance et de problématiques gériatriques dans l'environnement hostile qu'est la prison. Dans ce contexte, nous avons analysé l'état de santé des personnes âgées incarcérées de 70 ans et plus en faisant le premier état des lieux sur leur santé. Secondairement nous avons déterminé les particularités sanitaires qui impactent la santé en prison sur cette population. Une étude descriptive rétrospective mono-centrique a été réalisée en recueillant les données issues des dossiers médicaux de 34 patients inclus de 2016 à 2018 à l'UHSI de Lyon. 42 marqueurs de santé ont été implémentés dans une base de données, qui a permis de décrire l'état de santé avant d'en faire une analyse statistique croisée. Les inclus étaient des hommes en moyenne de 76,5 ans, souvent mariés ou veufs, prévenus ou condamnés de façon équivalente, ayant passé en moyenne 4 ans et 1 mois en détention. Les données brutes ont permis le calcul de différents scores dont le performance status OMS à 1,4 en moyenne, le score de charlson moyen à 6. L'autonomie était très diminuée. L'analyse statistique a n'a pas mis en évidence une association statistiquement significative entre les marqueurs de santé et le temps passé en prison ou le régime de détention hormis 1 exception. L'état de santé était altéré dans notre population étudiée, comme l'a déjà montré la littérature scientifique. Pour autant, il n'était pas trop éloigné de la santé des personnes hospitalisées du même âge. La perte d'autonomie et le déficit de mesures efficaces pour les contrer, amplifiait la dépendance et la vulnérabilité. Un score prédictif de l'attribution de du statut d'incompatibilité avec la détention a été théorisé suite à nos observations. L'étude a permis de mettre en évidence l'état de dépendance en inadéquation avec ce que les établissements pénitentiaires peuvent mettre en place pour s'adapter à cette nouvelle population qui grandit dans ses murs, en plus d'un état de santé diminué commun aux personnes âgées en général. Des études complémentaires sont nécessaires afin de confirmer nos premières observations et de les enrichir.

Book excerpt: The Violence of Modernity turns to Charles Baudelaire, one of the most canonical figures of literary modernism, in order to reclaim an aesthetic legacy for ethical inquiry and historical critique. Works of modern literature are commonly theorized as symptomatic responses to the trauma of history. In a climate that tends to privilege crisis over critique, Debarati Sanyal argues that it is urgent to rethink literary experience in terms that recall its contestatory potential. Examining Baudelaire's poems afresh, she shifts the focus of critical attention toward an account of modernism as an active engagement with violence, specifically the violence of history in nineteenth-century France. Sanyal analyzes a literary current that uses the traditional hallmarks of modernism—irony, intertextuality, self-reflexivity, and formalism—to challenge the historical violence of modernity. Baudelaire and the committed ironists writing in his wake teach us how to read and resist the violence of history, and thereby to challenge the melancholy tenor of our contemporary "wound culture." In a series of provocative readings, Sanyal presents Baudelaire's poetry as an aesthetic form that contests historical violence through rhetorical strategies of complicity, counterviolence, and critique. The book develops a new account of Baudelaire's significance as a modernist by dislodging him both from his traditional status as a practitioner of "art for art's sake" and from his more recent incarnation as the poet of trauma. Following her extended analysis of Baudelaire's poetry, Sanyal in later chapters considers a number of authors influenced by his strategies—including Rachilde, Virginie Despentes, Albert Camus, and Jean-Paul Sartre—to examine the relevance of their interventions for our current climate of trauma and terror.
