Using household- and plot-level data from Ghana, this study analyzes the main factors associated with farmers’ perceived tenure security. Individually, farmers perceive greater tenure security on plots acquired via purchase or inheritance than on land allocated by traditional authorities. Collectively, however, perceived tenure security lessens in communities with more active land markets and economic vibrancy. Migrant households and women in polygamous households feel less secure about their tenure, while farmers with political connections are more confident about their tenure security.

Book excerpt: Research since the 1990s highlights the importance of tenure rights for sustainable natural resource management, and for alleviating poverty and enhancing nutrition and food security for the 3.14 billion rural inhabitants of less-developed countries who rely on forests and agriculture for their livelihoods. The specific rights or combination of rights held by an individual, household, or community affects whether they have access to land and resources, as well as how those can be used and for how long. Equally important is the degree to which landholders perceive their tenure to be secure. Landowners are more likely to engage in land and resource conservation if they perceive that the likelihood of losing their land or resource rights is low. Between 2013 and 2021, the CGIAR Research Program on Policies, Institutions, and Markets (PIM) supported researchers to explore the drivers of tenure insecurity and their consequences, as well as mechanisms that can enhance tenure security. Their work focused on rights held by individuals and households, as well as collectively held rights. Studies found that tenure insecurity has a variety of negative consequences for natural resource management, agricultural productivity, and poverty reduction, but the sources of tenure insecurity differ for men and women, and for individual, household, and collective lands. Statutory recognition of customary rights, multistakeholder processes (MSPs) such as for land use planning, and organized social alliances such as Indigenous peoples’ groups have emerged as important mechanisms for securing rights or enhancing access to collectively held lands. Long-term partnerships, ongoing engagement, and training for actors at multiple scales increase the likelihood of successful implementation of tenure reforms. Further research on tenure security can contribute to achieving the Sustainable Development Goals, especially by clarifying how customary tenure can provide security and how tenure affects decision-making in multistakeholder platforms.

Book excerpt: Despite growing consensus on the socio-economic benefits emanating from enhanced land tenure security, issues related to how best to measure it and what constitute universal indicators of tenure (in)security are poorly understood. As a result, issues of what drives tenure security are poorly understood and inconclusive. This study, thus, examines the drivers of perceived tenure insecurity in Nigeria using the Nigeria LSMS-Panel General Household Survey of 2012/13. The determinants of perceive tenure insecurity are assessed across two indicators: private (idiosyncratic) tenure risk and collective (covariate) tenure security risk. The analysis shows that perceived risks of private land dispute are higher for female-headed households, households with lower social/political connectedness, and for land parcels acquired via the traditional/customary system, in contrast to having been purchased. Private tenure risk/insecurity is also higher in communities with vibrant land market and for households that are located close to urban centers, while the opposite is the case in communities with relative ease of land access. On the other hand, collective tenure risk is lower in communities with improved economic status. Finally, signifying the need to account for intra-household dimensions in implementing land reform interventions, results from a more disaggregated analysis show that tenure security is relatively higher on female-managed plots of female-headed households, while the opposite is the case for female-managed plots of male-headed households.

Book excerpt: While there is a large, though inconclusive, literature on the impact of land titles in Africa, little attention has been devoted to the study of land conflict, despite evidence on increasing incidence of such conflicts. Deininger and Castagnini use data from Uganda to explore who is affected by land conflicts, whether recent legal changes have helped to reduce their incidence, and to assess their impact on productivity. Results indicate that female-headed households and widows are particularly affected and that the passage of the 1998 Land Act has failed to reduce the number of pending land conflicts. The authors also find evidence of a significant and quantitatively large productivity-reducing impact of land conflicts. This suggests that, especially in Africa, attention to land-related conflicts and exploration of ways to prevent and speedily resolve them would be an important area for policy as well as research. This paper--a product of Rural Development, Development Research Group--is part of a larger effort in the group to explore the impact of land policies.

Book excerpt: Increased global demand for land posits the need for well-designed country-level land policies to protect long-held rights, facilitate land access and address any constraints that land policy may pose for broader growth. While the implementation of land reforms can be a lengthy process, the need to swiftly identify key land policy challenges and devise responses that allow the monitoring of progress, in a way that minimizes conflicts and supports broader development goals, is clear. The Land Governance Assessment Framework (LGAF) makes a substantive contribution to the land sector by providing a quick and innovative tool to monitor land governance at the country level. The LGAF offers a comprehensive diagnostic tool that covers five main areas for policy intervention: Legal and institutional framework; Land use planning, management and taxation; Management of public land; Public provision of land information; and Dispute resolution and conflict management. The LGAF assesses these areas through a set of detailed indicators that are rated on a scale of pre-coded statements (from lack of good governance to good practice). While land governance can be highly technical in nature and tends to be addressed in a partial and sporadic manner, the LGAF posits a tool for a comprehensive assessment, taking into account the broad range of issues that land governance encompasses, while enabling those unfamiliar with land to grasp its full complexity. The LGAF will make it possible for policymakers to make sense of the technical levels of the land sector, benchmark governance, identify areas that require further attention and monitor progress. It is intended to assist countries in prioritizing reforms in the land sector by providing a holistic diagnostic review that can inform policy dialogue in a clear and targeted manner. In addition to presenting the LGAF tool, this book includes detailed case studies on its implementation in five selected countries: Peru, the Kyrgyz Republic, Ethiopia, Indonesia and Tanzania.

Beyond LTR, this book also provides insights into emerging issues post-land tenure reform and what efforts are being undertaken to ensure sustainable land administration and land governance. The book draws on various types of secondary data, including relevant laws, policies, operational manuals and published studies, as well as consultants' reports. It also uses primary data comprising mainly interviews with policy makers, land professionals, academics, Civil Society Organisations (CSOs), donor organizations and the general public. This book is in four parts, with nine chapters. Part 1 provides the relevant context of the book and contains two chapters (chapters 1 and 2). Chapter 1 is the introduction and explains why land is so important; it discusses some of the issues land resources currently face, especially, in developing countries and why it should be managed and governed properly; it outlines why there is an urgent need for an improved land governance and land administration system or land tenure reform where this is not taking place, and it provides a summary of the importance of documenting Rwanda's LTR programme and explains why this book is timely and different from existing literature on land tenure reform. In chapter 2, the historical context of land tenure systems in Africa is summarized. The chapter describes the key exercises that were undertaken as part of preparing the ground for the land tenure reform programme. Part 3 concentrates on implementation of the LTR programme and contains four chapters (chapters 4 to 7). Chapter 4 focuses on how the policy and regulatory frameworks were established which supported the LTR programme. Chapter 5 details the institutional framework that was developed to guide the LTR programme implementation, defining each institution's mandate and how they interacted with each other as well as how the capacity of these institutions was built to apportion responsibilities accordingly. Chapter 6 explains the whole process of rolling out the land tenure regularization process countrywide and the key steps that were involved, as well as the implementation process. In chapter 7, the key ingredients required to ensure that what has been achieved by the LTR would be properly maintained are assessed. The last part of the book (Part 4) assesses the impact of the LTR programme by discussing the socioeconomic benefits in chapter 8 where testimonies from various stakeholders and LTR beneficiaries are also presented. Chapter 9 concludes the book and a set of key success factors and lessons are also outlined for other countries wishing to follow a similar route as Rwanda in terms of land tenure reform.

Book excerpt: In large Latin American cities the number of dwellings in informal settlements ranges from one-tenth to one-third of urban residences. These informal settlements are caused by low income, unrealistic urban planning, lack of serviced land, lack of social housing, and a dysfunctional legal system. The settlements develop over time and some have existed for decades, often becoming part of the regular development of the city, and therefore gaining rights, although usually lacking formal titles. Whether they are established on public or private land, they develop irregularly and often do not have critical public services such as sanitation, resulting in health and environmental hazards. In this report from the Lincoln Institute of Land Policy, author Edesio Fernandes, a lawyer and urban planner from Latin America, studies the options for regularization of the informal settlements. Regularization is looked at through established programs in both Peru and Brazil, in an attempt to bring these settlements much needed balance and improvement. In Peru, based on Hernando de Soto's theory that tenure security triggers development and increases property value, from 1996 to 2006, 1.5 million freehold titles were issued at a cost of $64 per household. This did result in an increase of property values by about 25 percent, making the program cost effective. Brazil took a much broader and more costly approach to regularization by not only titling the land, but improving public services, job creation, and community support structures. This program in Brazil has had a cost of between $3,500 to $5,000 per household and has affected a much lower percent of the population. The report offers recommendations for improving regularization policy and identifies issues that must be addressed, such as collecting data with baseline figures to get a true evaluation of the benefit of programs established. Also, it shows that each individual informal settlement must have a customized plan, as a single approach will not work for each settlement. There is a need to include both genders for long-term effectiveness and to find ways to make the regularization self-sustaining financially. Any program must be closely monitored to insure the conditions are improved for the marginalized, as well as be sure it is not causing new informal settlements to be established.
