Par la suite, le souci de rendre concrets ces «droits inhérents à la personne humaine» dans la perspective de leur meilleure protection a conduit la doctrine à adopter une catégorisation dualiste desdits droits. Catégorisation qui, elle-même, est fonction du type d'acteurs sociaux soutenant tel ou tel autre droit. C'est ainsi qu'en 1966, les Nations Unies ont adopté deux pactes relatifs l'un aux droits dits de la première génération: il s'agit des droits civils et politiques; et l'autre aux droits dits de la deuxième génération, à savoir les droits économiques, sociaux et culturels. Les auteurs ont d'ailleurs qualifié cette deuxième catégorie de «créances» de l'Etat sur la collectivité. Une troisième génération des droits de l'homme, cette fois-ci motivée non plus par les individus ou l'Etat, mais par la communauté internationale toute entière va naître, il s'agit des droit dits de la solidarité (le droit à un environnement sain, le droit à l'eau potable, le droit à la paix, le droit au développement. bref, le droit au «bien être»). En effet, dans les débuts des années 70, une nouvelle idée motivée par les nouveaux Etats indépendants d'Afrique et d'ailleurs ayant accédé à l'Organisation des Nations Unies émerge et se consolide progressivement, manifestant le souci qu'il y a à combler le retard' de ces Etat du fait de la colonisation. Tel est le point de départ d'un nouvel engagement non plus seulement des nouveaux Etats indépendants mais, de toute la communauté internationale à oeuvrer pour la réalisation d'«un monde meilleur pour tous». En réalité, à la suite d'une réflexion profonde sur cette troisième génération des droits de l'Homme, l'on ne peut qu'être tenté de la considérer comme étant une synthèse des deux premières générations, l'une et l'autre se révélant nécessairement complémentaires pour la réalisation d'un «mieux être» pour les hommes.

The European situation, which this publication aims to analyse, is painful: the entire continent is afflicted by increasing poverty and consequently by the erosion of living conditions and social conflicts.The economic and financial crisis has resulted in the loss of millions of jobs, and created job insecurity for many still working. Economic insecurity raises social tensions, aggravating xenophobia, for instance. Yet the economic and financial crisis could present a good opportunity to rethink the economic and social system as a whole. Indeed, poverty in modern societies has never been purely a question of lack of wealth. It is therefore urgent today to devise a new discourse on poverty. In pursuit of this goal, the Council of Europe is following up this publication in the framework of the project "Human rights of people experiencing poverty", co-financed by the European Commission.

These twin characteristics explain why international society is also riddled with the two major forms of injustice which Nancy Fraser identified as afflicting national societies. First, the economic and social disparities between states caused outcry in the 1950s when the first steps were taken towards decolonisation. These inequalities, to which a number of emerging states now contribute, are still glaring and still pose the problem of the gap between formal equality and true equality. Second, international society is increasingly confronted with culture- and identity-related claims, stretching the dividing line between equality and difference. The less-favoured states, those that feel stigmatised, but also native peoples, ethnic groups, minorities and women now aspire to both legal recognition of their equal dignity and the protection of their identities and cultures. Some even seek reparation for injustices arising from the past violation of their identities and the confiscation of their property or land. In answer to these two forms of claim, the subjects of international society have come up with two types of remedy encapsulated in legal rules: the law of development and the law of recognition. These two sets of rights are neither wholly autonomous and individualised branches of law nor formalised sets of rules. They are imperfect and have their dark side. Yet they can be seen as the first milestones towards what might become a fairer international society; one that is both equitable (as an answer to socio-economic injustice) and decent (as an answer to cultural injustice). This book explores this evolution in international society, setting it in historical perspective and examining its presuppositions and implications.
