Book excerpt: Esta tese de doutorado aborda os temas da Propriedade Industrial, dos Produtos Naturais e da Comercialização de Tecnologia, desdobrados nos seguintes objetivos: i) a prospecção tecnológica dos setores industriais que utilizam os produtos naturais da classe dos óleos essenciais, terpenos e terpenóides, através da coleta das informações descritas em documentos de patentes; e ii) o estudo dos contratos de transferência de tecnologia estabelecidos pelas empresas do setor de Aromas e Fragrâncias no Brasil. Óleos essenciais, ricos em compostos terpênicos e terpenóides, são importantes matérias-primas industriais. Nessa Tese, são identificadas, as áreas tecnológicas em que esses produtos naturais são utilizados, através do conhecimento registrado nos documentos de patentes dos Escritórios de Marcas e Patentes dos Estados Unidos (USPTO) e Brasil (INPI), no período de 1980 a 2003. Em outro aspecto deste trabalho, investigou-se o comportamento adotado para as transferências de tecnologias praticadas pelas empresas do setor de Aromas e Fragrâncias localizadas no Brasil, através do conhecimento divulgado nos contratos de transferência tecnológica relacionados com o Licenciamento de Tecnologias, o Uso de Marcas Comerciais e a Participação nos custos de Pesquisa e Desenvolvimento, no âmbito jurídico do Escritório Brasileiro de Marcas e Patentes. Utilizou-se o Sistema de Informação do Instituto Nacional da Propriedade Industrial (SINPI/INPI) para os Contratos de Transferência de Tecnologia, indexados pela Classificação Nacional de Atividades Econômicas (CNAE), do Instituto Brasileiro de Geografia e Estatística (IBGE), enfocando o uso de óleos essenciais e seus constituintes terpênicos e terpenóides, no mesmo período de 1980 a 2003. Evidenciou-se, dentre outros aspectos, a pouca participação dos atores nacionais (empresas, centros de pesquisa, inventores, etc.) no requerimento de direitos de patente ou na obtenção dos mesmos, em relação aos dados coletados em ambos os Escritórios de Marcas e Patentes (Brasileiro e Norte-americano). Também foi mínimo o registro de invenções desenvolvidas com espécies vegetais endêmicas ao Brasil. Em terceiro, verificou-se que a transferência dos direitos de propriedade das marcas comerciais foi o principal tipo de contrato estabelecido. Em relação á tecnologia em si, há a dependência da contratação de serviços de outros países.

Vereinfacht gesagt geht es also nicht nur um die Nutzung von Enzymen, Zellen oder Mikroorganismen zur Produktion oder Verbesserung von Gütern, sondern besonders auch um biotechnologische Verfahren zur Modifikation bestehender Lebewesen, aber auch zur Produktion künstlicher, neuer Lebewesen wie Bakterien oder sogar beispielsweise Mäusen mit einzigartigem Phänotyp. Diese Anwendungsbeispiele lassen bereits auf die aktuellen, immensen Einflüsse der Biotechnologie schließen, mehr aber noch verdeutlichen sie das Potenzial des Menschen, über Biotechnologie die Welt in einem nahezu schöpferischen Maße zu verändern.
