Book excerpt: This study compares and contrasts urban regeneration partnerships in the UK with urban regimes in the USA. It is argued that regime theory, as developed by Elkin and Stone, neither describes nor explains the contrasting forms of collaboration in the UK. The development of urban regeneration partnerships has been driven by a combination of two main factors: the development of an ideological perception within local government elites that urban regeneration depends on market led growth, and a series of central government regeneration initiatives. These initiatives, designed to encourage and where necessary coerce local authorities into partnership working have resulted in highly bureaucratised, but symbolic, partnerships with local business elites. Business activity in these partnerships thus far has been marginal. It is unlikely to be fruitful, therefore, for scholars to seek 'Stonean' regimes in the UK. On the other hand, to describe such partnerships as 'regimes' is misleading and results in a lack of conceptual clarity. Despite the fashion for copying urban policy from the USA, the institutions of urban politics in the UK are likely to remain resolutely different.

As a result, the DoD lacks a framework at the strategic level to accurately assess potential partnerships and their likelihood of success. As this analysis proves, cooperation is not guaranteed, especially in military partnerships. Without a framework to assess the likelihood of success of a potential partnership, the DoD risks engaging in multinational endeavors more likely to fail than succeed. This paper examines three case studies – the Strategic Airlift Capability (SAC) program, the NATO Response Force (NRF), and the Wideband Global Satellite (WGS) Communications program – through the lens of international regime theory. As the case studies demonstrate, factors for regime success vary according to three distinct phases of the regime’s life cycle regime formation, transition to operations, and sustainment. Strategists should consider the relevant factors in each of the three phases with a life cycle perspective before engaging in partnership initiatives. Ignoring the relevant factors in any of the three phases may result in a failed initiative. The similarities between the highly successful WGS and SAC programs suggest that, despite their vast functional differences, successful military regimes share causal variables. The particular variables include the power-based variables of egoistic self-interest, political power, and issue-area specificity. The complete absence of these same characteristics in the flailing NRF further strengthens the case that these variables are both necessary and sufficient for regime success. Finally, the case study results offer the basis for a framework to assess current and future military partnership endeavors."--Abstract.

It examines the structure and functioning of Business Leadership Coalitions (BLCs) in major American cities and their collective role as business partners in cross-sectoral coalitions. A distinction is made between varieties of partnering for governance purposes. The results show a greater heterogeneity and diversity of engagement and partnering types than would be predicted from traditional regime typologies, and an "engagement portfolio" concept of civic activism is proposed to encompass the diverse motives, activities, and partnering configurations exhibited by the BLCs. The findings suggest the need for changesin regime theory frameworks in order to capture the full richness and realities of business sect orparticipation in PPPs.

The function of the court is to interpret the language of a statute, whereas it is for the legislature to make enactments and for the courts to enforce such enactments. Courts are not legislators, they have to carry out loyally the directions of the legislature. Two models of interpretation stands in present world, agency and partnership model. According to the agency model while interpreting a statute, the Court has to discover the intent of the legislature or the purpose behind legislation. The partnership model views the Court as a partner in legislative enterprise with legislature, hence, while interpreting a statute the Court should seek a sensible to avoid rigors of law. Judge does not create normative text but rather gives it meaning. The static vision of statutory interpretation prescribed by traditional doctrine is strikingly outdated. Interpretation of a statute evolves over time because of changing factual contexts and the changing perspectives of its interpreters. Statutory interpretation should appropriately balance a number of factors, including predictability and certainty, economic efficiency, fairness, and the public interest.

Book excerpt: The study of regimes can contribute to our understanding of international politics only if regimes represent more than international organizations and less than all international relations. The conceptualization of regimes developed here accepts the realist image of international politics, in which autonomous self-interested states interact in an anarchic environment. Yet there are situations in which rational actors have an incentive to eschew unconstrained independent decision making, situations in which individualistic self-interested calculation leads them to prefer joint decision making (regimes) because independent self-interested behavior can result in undesirable or suboptimal outcomes. These situations are labeled dilemmas of common interests and dilemmas of common aversions. To deal with these, states must collaborate with one another or coordinate their behavior, respectively. Thus there are different bases for regimes, which give rise to regimes with different characteristics. Coordination is self-enforcing and can be reached through the use of conventions. Collaboration is more formalized and requires mechanisms both to monitor potential cheating and to insure compliance with the regime. The article elucidates the assumptions of such an interest-based approach to regimes, assimilates alternative explanations into this framework, and develops the implications for regime maintenance and change.
