Book excerpt: A presente tese tem por objetivo analisar a participação popular na defesa do meio ambiente sob o enfoque do direito processual civil brasileiro, em que o processo civil se apresenta como instrumento capaz de viabilizar a participação pública na preservação da qualidade ambiental. Após incursão inicial pelo tema geral da participação popular na defesa do meio ambiente no contexto da democracia participativa, com indicação de seus fundamentos constitucionais e modalidades principais, passa-se ao estudo sistematizado da participação ambiental por intermédio do processo jurisdicional, fundada na garantia constitucional do acesso participativo à justiça e implementada pelo sistema de direito processual coletivo. No exame dos diversos institutos processuais, enfatizase a titularidade do poder de agir em juízo, atribuída a pessoas físicas (indivíduos e cidadãos) e entes intermediários (associações civis, sindicatos, Ordem dos Advogados do Brasil, Ministério Público e Defensoria Pública) que atuam na tutela do direito de todos ao meio ambiente, com legitimidade não só para agir como também para intervir nos processos coletivos ambientais, inclusive, em determinados casos, na condição de amici curiae ou de partícipes em audiências públicas. Destaca-se a questão da representatividade adequada dos sujeitos legitimados - distinta da representação adequada -, restrita aos entes intermediários, uma vez que as pessoas físicas agem por direito próprio, sem relação de representação com os demais cotitulares do direito protegido. Discriminam-se os requisitos de representatividade adequada a serem preenchidos pelos legitimados ativos e a extensão do controle judicial admitido a respeito. Ressaltam-se a dimensão política da jurisdição e a expansão desta no Estado da democracia participativa, com afirmação da legitimidade política dos juízes e do Poder Judiciário para canalizar a participação pública ambiental. Analisam-se a distribuição do exercício da jurisdição, pelas regras de comp.
