Book Synopsis Ripe for Reform: UK Scrutiny of International Trade Agreements by : Emily Jones
Download or read book Ripe for Reform: UK Scrutiny of International Trade Agreements written by Emily Jones and published by . This book was released on 2020 with total page pages. Available in PDF, EPUB and Kindle. Book excerpt: Now that the UK has left the EU, the Government is negotiating trade agreements for the first time in almost 50 years. What role should Parliament play in scrutinising trade deals? This paper compares current processes of parliamentary scrutiny in the UK, United States, European Union, Australia, and Canada. It shows how parliaments in the US and EU have extensive powers of scrutiny, including oversight of the negotiations, and a debate and vote on the trade agreement before it is ratified. In contrast, in the UK, Australia, and Canada, the negotiation and ratification of trade agreements is an executive power, and parliaments are not guaranteed a debate or vote on trade agreements before ratification. Their main role is to enact any legislation that is needed for the trade agreement to come into effect, but only some parts of an agreement may require implementing legislation, and this may be secondary legislation which is not subject to parliamentary debate. Unless changes are made, the UK's future trade deals will receive less scrutiny than the trade deals it entered as part of the EU. There are compelling reasons for strengthening Parliament's scrutiny role. Contemporary trade agreements involve policy decisions that affect the everyday lives of citizens. Effective scrutiny would improve the quality of decision-making, provide leverage in negotiations, and reassure negotiating partners any treaty they negotiate with the UK will be ratified and implemented. Properly engaging devolved administrations and legislatures would respect devolution and ensure that all parts of the UK support negotiated outcomes. For scrutiny to be effective, Parliament needs access to much more information throughout negotiations and more time to scrutinise final agreements, and there are strong grounds for guaranteeing Parliament the opportunity to shape the negotiating mandate, and to debate and vote on treaties before they are ratified. This paper identifies practices in other countries that the UK can learn from.
Book Synopsis Parliamentary Scrutiny of the European Commission by : Milan Remáč
Download or read book Parliamentary Scrutiny of the European Commission written by Milan Remáč and published by . This book was released on 2018 with total page 93 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Treaties provide the European Parliament with various opportunities to exercise its powers of political oversight of the European Commission and its actions. The European Parliament's application of these prerogatives increases the democratic legitimacy of the European Union, and the transparency and accountability of the European executive. This study examines the status quo of the European Parliament's powers of scrutiny over the European Commission. The cases examined pertain mainly to electoral and institutional issues, motions of censure, parliamentary questions, inquiry committees and special parliamentary committees and reporting, consultation and provision of information. It also touches upon scrutiny in budgetary issues, scrutiny of delegated acts, scrutiny in the legislative procedure, legal proceedings and the EU's external relations.

Download or read book Parliament written by Alexander Horne and published by Bloomsbury Publishing. This book was released on 2016-06-02 with total page 321 pages. Available in PDF, EPUB and Kindle. Book excerpt: This collection of essays by leading academics, lawyers, parliamentarians and parliamentary officials provides a critical assessment of the UK Parliament's two main constitutional roles-as a legislature and as the preeminent institution for calling government to account. Both functions are undergoing change and facing new challenges. Part 1 (Legislation) includes chapters on Parliament's emerging responsibilities for pre-legislative scrutiny of government Bills and for evaluating proposed legislation against explicit constitutional standards. The impact on legislation of the European Union and the growing influence of the House of Lords are also examined. Part 2 (Accountability) investigates how Parliament operates to scrutinise areas of executive action previously often shielded from effective parliamentary oversight, including national security, war-making powers and administrative justice. There are also chapters on parliamentary reform, including analysis of the House of Commons 'Wright reforms', parliamentary sovereignty, privilege and the European Convention on Human Rights, Euroscepticism, and parliamentary sovereignty and the regulation of lobbyists. The book will be of interest to anyone who is curious about the work of Parliament and is aimed at legal academics, practitioners and political scientists.

This book was released on 2010-01-18 with total page 82 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Constitutional Reform and Governance Bill was re-introduced in the House of Commons on 19 November 2009 and the Committee welcomes a number of aspects of the Bill which is implementing some of the commitments made by the Prime Minister in his Governance of Britain statement in July 2007. But the Committee considers there are a number of significant omissions from the Bill including in relation to judicial appointments, parliamentary scrutiny of security and intelligence matters, and the restrictive judicial interpretation of the meaning of public function in the Human Rights Act. They recommend amendments relating to the latter two points. They also look at Protest around Parliament, Ratification of Treaties and Right to a fair hearing and access to a court in the determination of civil rights. The Video Recordings Bill was introduced into the House of Commons on 15 December 2009 and is a fast track piece of legislation which repeals and revives the provisions of the Video Recordings Act 1984 in order to enable them to be notified to the European Commission under the Technical Standards Directive and so secure its enforceability. The Committee considers the human rights issues raised by this Bill should be subjected to parliamentary scrutiny. However as the 1984 Act, serves as an important child protection purpose, that are currently unenforceable, the Committee accepts the need for fast tracking this legislation and does not propose to further scrutinise this Bill.
