Book excerpt: A call for limits on Constitutional amendments. New introduction by John R. Vile, Middle Tennessee State University. Originally published: New York: Dauber & Pine Bookshops, 1932. XXVI (III-XXVI new Introduction), vii, 321 pp. Written in 1932, this book attempts to situate the U.S. Constitution within its historical context and argues for the types of limits on constitutional amendments that some scholars advocate to this day. Thomas: interprets the 2nd amendment as a state rather than a federal issue, examines the question of substantive limits on the content of constitutional amendments, advances the then novel idea that the Bill of Rights limited both the national government and the states, proclaims the unconstitutionality of the 18th amendment, which prohibited alcohol, questions equal state suffrage in the U.S. Senate, the extensive powers of the president, the four-year presidential election cycle, "the composition and tenure of the Federal Judiciary" and the authority of the U.S. Supreme Court. SAMUEL BELL THOMAS [1868-1943] practiced law in New York. He graduated from the University of Texas and received his law degree from Southwestern University. He lost his bid for Congress as a New York Independence League candidate in 1910."

Available in PDF, EPUB and Kindle. Book excerpt: Current controversies over abortion, affirmative action, school prayer, hate speech, and other issues have sparked considerable public debate about how the U.S. Constitution should be interpreted. Such controversies, along with the changing composition of an often deeply divided Supreme Court, have led to a resurgence of interest in theories of constitutional interpretation. This anthology, edited by Susan J. Brison and Walter Sinnott-Armstrong, presents some of the most exciting and influential contemporary work in this area. Written by ten of the country's most prominent legal scholars, the selections represent a wide variety of interpretive approaches, reflecting different political orientations from the far right to the far left. These theorists have drawn on a variety of other disciplines, including literature, economics, history, philosophy, and politics, and have in turn influenced these fields. The selections were chosen for their accessibility, originality, variety, and importance. Together they provide an excellent introduction to constitutional interpretation as well as a valuable collection for experienced scholars in the field.

Available in PDF, EPUB and Kindle. Book excerpt: A New York Times Book Review Editors' Choice An innovative account of Abraham Lincoln, constitutional thinker and doer Abraham Lincoln is justly revered for his brilliance, compassion, humor, and rededication of the United States to achieving liberty and justice for all. He led the nation into a bloody civil war to uphold the system of government established by the US Constitution—a system he regarded as the “last best hope of mankind.” But how did Lincoln understand the Constitution? In this groundbreaking study, Noah Feldman argues that Lincoln deliberately and recurrently violated the United States’ founding arrangements. When he came to power, it was widely believed that the federal government could not use armed force to prevent a state from seceding. It was also assumed that basic civil liberties could be suspended in a rebellion by Congress but not by the president, and that the federal government had no authority over slavery in states where it existed. As president, Lincoln broke decisively with all these precedents, and effectively rewrote the Constitution’s place in the American system. Before the Civil War, the Constitution was best understood as a compromise pact—a rough and ready deal between states that allowed the Union to form and function. After Lincoln, the Constitution came to be seen as a sacred text—a transcendent statement of the nation’s highest ideals. The Broken Constitution is the first book to tell the story of how Lincoln broke the Constitution in order to remake it. To do so, it offers a riveting narrative of his constitutional choices and how he made them—and places Lincoln in the rich context of thinking of the time, from African American abolitionists to Lincoln’s Republican rivals and Secessionist ideologues. Includes 8 Pages of Black-and-White Illustrations

Available in PDF, EPUB and Kindle. Book excerpt: Is the world facing a serious threat to the protection of constitutional democracy? There is a genuine debate about the meaning of the various political events that have, for many scholars and observers, generated a feeling of deep foreboding about our collective futures all over the world. Do these events represent simply the normal ebb and flow of political possibilities, or do they instead portend a more permanent move away from constitutional democracy that had been thought triumphant after the demise of the Soviet Union in 1989? Constitutional Democracy in Crisis? addresses these questions head-on: Are the forces weakening constitutional democracy around the world general or nation-specific? Why have some major democracies seemingly not experienced these problems? How can we as scholars and citizens think clearly about the ideas of "constitutional crisis" or "constitutional degeneration"? What are the impacts of forces such as globalization, immigration, income inequality, populism, nationalism, religious sectarianism? Bringing together leading scholars to engage critically with the crises facing constitutional democracies in the 21st century, these essays diagnose the causes of the present afflictions in regimes, regions, and across the globe, believing at this stage that diagnosis is of central importance - as Abraham Lincoln said in his "House Divided" speech, "If we could first know where we are, and whither we are tending, we could then better judge what to do, and how to do it."

Dr. Claudia Welch explores how the effectiveness of a physician extends far beyond the ability to prescribe correct treatments, and how mastering the art of doctoring can make the medicine more effective. Drawing on Eastern medical traditions and experience as well as on Western science, Dr. Welch examines how we know what we know, the mechanics of doctor-patient emotional contagion, and the degree to which a patient's sensory experience in a medical office affects their experience of treatments delivered. Dr. Welch also offers practical steps that doctors can take to cultivate more refined perceptive abilities and improve results. Dr. Welch's book will be essential reading for all health care practitioners interested in understanding the art of their practice and how it can enhance therapeutic outcomes, including doctors of Ayurveda, Chinese medicine, Naturopathy, as well as western medical professionals and other complementary health practitioners.
