Apesar de todos sabermos disso, uma somatória de fatores, como a distribuição naturalmente desigual do recurso, o uso não sustentável e a concorrência entre os diversos usos, ocasionou uma grave crise hídrica global, razão pela qual apenas recentemente a comunidade internacional passou a observar as implicações negativas das atividades humanas para o ciclo hidrológico e as violações de direitos humanos ligadas à falta de acesso à água e ao saneamento básico. Também o Papa Francisco, em sua encíclica Laudato Si sobre o cuidado da Terra como nossa casa comum, chama a atenção para a diminuição da qualidade dos recursos hídricos e a tendência de considerá-los mercadoria, afirmando que o acesso à água potável e segura é um direito humano essencial, fundamental e universal, porque determina a sobrevivência das pessoas e, portanto, é condição para o exercício de outros direitos humanos. Diante deste cenário, favorecido pela Campanha da Fraternidade Ecumênica de 2016, que visa chamar a atenção para o direito ao saneamento básico para todos, a autora oferece, em linguagem acessível, um interessante estudo da relação entre os direitos humanos e o direito ambiental no campo jurídico internacional. De sua análise de estudos teóricos interdisciplinares, de diversos documentos jurídicos e jurisdições de proteção aos direitos humanos, bem como da avaliação dos modelos de outros países, emerge a conclusão de que é preciso buscar maior positivação e efetivação do direito à água e ao saneamento adequados nos âmbitos internacional, regional e local. Nas palavras de Léo Heller, relator especial das Nações Unidas para o direito humano ao abastecimento de água seguro e ao esgotamento sanitário, trata-se de uma abrangente revisão sobre o direito humano ao abastecimento de água, de modo a ampliar a compreensão sobre esse direito essencial, incentivar o aprofundamento do tema e instruir o sistema judiciário a reconhecer esse direito. Leitura imprescindível, ainda mais relevante diante do atual contexto de escassez de recursos hídricos e de desastres ambientais como o de Mariana, que destruiu o Rio Doce - a mais importante bacia hidrográfica da região Sudeste do Brasil - causando desabastecimento de água e afetando a vida de cerca de 3 milhões de habitantes de Minas Gerais e do Espírito Santo.

Além disso, ampliou a atribuição da ANA que até então regulava os recursos hídricos, passando a normatizar e fiscalizar o setor e a ser denominada Agência Nacional de Águas e Saneamento Básico. Concomitantemente extinguiu os contratos de programa (respeitados os seus termos finais vigentes), submetendo todas as relações jurídicas a concessão. Diplomas internacionais seguem os mesmos planos de acesso à água e ao esgotamento sanitário, ao mesmo tempo em que preocupa a escassez da água provocada pelas mudanças climáticas. Em certos lugares do mundo, o movimento de privatização da exploração do serviço de saneamento básico teve retomada pelo Estado, dentre os principais motivos estava a má qualidade do serviço e o aumento abusivo das tarifas. Nesse contexto, o presente trabalho tem por objetivo analisar em que medida esses impactos negativos podem ser evitados, minorados e de modo a que se tenha uma prestação de acordo com o Estado Democrático de Direito. Após verificar o regime jurídico vigente no que concerne a essa relação jurídica e suas interpretações, concluímos pela necessidade de uma releitura ou (re)interpretação a partir da teoria discursiva de Habermas, na qual a participação popular é inexorável para proteger todos os direitos fundamentais que o saneamento básico compreende, bem como para conferir autonomia privada e pública.

Book excerpt: In recent decades there has been an exponential increase in large hydroelectric plants in Brazil, especially in the Amazon region. These large hydraulic structures impact the environment and the lives of people living in the places where they settle and require a special type of water governance. The dictatorial regime (1964-1985) created a "standard" for the construction of these great structures, through an institutional and legal framework, which benefited the Brazilian business elite but also, through the creation of a popular imagination, which shows itself lasting progress on the country's progress and development. The suspension of security, the fragility of institutional environmental structures, the disrespect for indigenous reserves, the lack of clarity about the concept of "affected population" and the non-payment of fair compensation were identified as one of the main challenges for a democratic water governance in the country. In the late 1970s, the Dam-Affected Movement (MAB) began its organization and is also studied in this research. The study is an important and insightful academic contribution to the understanding of the main bottlenecks of effective water governance in Brazil.
