An idealistic, sincere, and hardworking monarch whose ultilitarian bent, humanitarian instincts, and ambitious programs of reform in every area of public concern have prompted historians to term him an "enlightened despot," "revolutionary Emperor," "philosopher on a throne," and a ruler ahead of his time, Joseph has also been condemned for being insensitive to the phobias and follies of his subjects, essentially unrealistic, almost utopian, in establishing his goals, and dogmatic and overly precipitous in trying to achieve them. Efforts to analyze and explain the actions of this complex and controversial personality have involved a number of savants in investigations of "Josephinism" (or as I prefer to call it, "Josephism"), dealing in great detail with the motiva tions, substance, and influence of his innovations. The starting point of the analysis is the recognition of contradictions within the legal order. In this respect the theory may use the experience of both American Critical Legal Studies and the German attempts to formulate a legal theory for the social state. The key for understanding how the contradictory concrete legal material may produce varying results on the level of legal decisions is the systematization, the general principles of the law. The analysis does not, however, stop at this theoretical level. The methodology is tested through a discussion of some features of modern private law. Some key elements of contract law, including consumer law, of the Welfare State are singled out. The work focuses on the person-orientation of modern law as a challenge to the traditional abstract legal form. The aim is to explore the limits for a contract law radically oriented towards the personal social and economic needs of the parties. This endeavour involves the creation of new legal concepts such as social force majeure.

Drawing on his research of primary materials written in Dutch and Latin and found in libraries all over Europe, even including the Soviet Union, Theo Verbeek opens a period of Descartes's life and of the development of Cartesian philosophy that has been virtually closed since Descartes's death. Verbeek's aim is to provide as complete a picture as possible of the discussions that accompanied the introduction of Descartes's philosophy into Dutch universities, especially those in Utrecht and Leiden, and to analyze some of the major problems that philosophy raised in the eyes of Aristotelian philosophers and orthodox theologians. The period covered extends from 1637, the year in which Descartes published his Discours de la Méthode, until his death in 1650. Verbeek demonstrates how Cartesian philosophy moved successfully into the schools and universities of Holland and how this resulted in a real evolution of Descartes's thought beyond the somewhat dogmatic position of Descartes himself. Verbeek further argues that this progression was an essential step in the universal propagation of Cartesian philosophy throughout Europe during the second half of the seventeenth century. As he details the disputes between Cartesians and anti-Cartesians in Holland, Verbeek shows how the questions raised were related on the one hand to religious conflicts between the Remonstrants and the Orthodox Calvinists and on the other hand to political conflicts between more liberal factions fighting for the union of church and state to enhance religious control of society in general. Contending that Descartes and Cartesian philosophy were central to the development of the modern Dutch state, Verbeek illuminates the role they played in Dutch political, religious, and intellectual life.
