This book was released on 2009-01-01 with total page 594 pages. Available in PDF, EPUB and Kindle. Book excerpt: No one doubts any longer that sustainable development is a normative imperative. Yet there is unmistakably a great reluctance to acknowledge any legal basis upon which companies are obliged to forgo 'shareholder value' when such a policy clearly dilutes responsibility for company action in the face of continuing environmental degradation. Here is a book that boldly says: 'Shareholder primacy' is wrong. Such a narrow, short-term focus, the author shows, works against the achievement of the overarching societal goals of European law itself. The core role of EU company and securities law is to promote economic development, notably through the facilitation of market integration, while its contributory role is to further sustainable development through facilitation of the integration of economic and social development and environmental protection. There is a clear legal basis in European law to overturn the poorly substantiated theory of a 'market for corporate control' as a theoretical and ideological basis when enacting company law. With rigorous and persuasive research and analysis, this book demonstrates that: European companies should have legal obligations beyond the maximization of profit for shareholders; human and environmental interests may and should be engaged with in the realm of company law; and company law has a crucial role in furthering sustainable development. As a test case, the author offers an in-depth analysis of the Takeover Directive, showing that it neither promotes economic development nor furthers the integration of the economic, social and environmental interests that the principle of sustainable development requires. This book goes to the very core of the ongoing debate on the function and future of European company law. Surprisingly, it does not make an argument in favour of changing EU law, but shows that we can take a great leap forward from where we are. For this powerful insight - and the innumerable recognitions that support it - this book is a timely and exciting new resource for lawyers and academics in 'both camps' those on the activist side of the issue, and those with company or official policymaking responsibilities.

Available in PDF, EPUB and Kindle. Book excerpt: The discussion about energy perspectives beyond 2020, up to 2030 and eventually 2050 has started. There seems to be a verbal consensus on the necessity of ambitious climate change mitigation policies, without a convincing perspective of the necessary policy decisions to be reached in due time. Methods to achieve greenhouse gas reduction as well as energy security vary from aiming for 100% renewable energies and setting up appropriate policy frameworks to implementing a mix of renewables comprising so-called clean fossil and nuclear energy. This book provides an analysis of the different approaches and the reasons why there is no sustainable alternative to aiming for 100% renewables – and how this vision could come true. The book provides an overview and in-depth analysis of a vital debate. It describes how the present policy framework with 2020-targets for the share of renewables, for increase of energy efficiency and for greenhouse gas emissions reduction was developed and how it has been implemented so far. Furthermore, it describes and analyses the emerging debate about the future of our energy system and the necessary next steps and targets leading up to 2030.

Available in PDF, EPUB and Kindle. Book excerpt: The full impact of austerity policies across Europe is still being assessed, but it is clear that their gendered impacts have been consistently severe, structural and manifold. They have also been, until now, under-researched and under-estimated. This book brings together the research of leading feminist economists in the area of gender and austerity economics to perform a rigorous gender-impact analysis both at national and pan-European levels. The chapters not only offer thorough evidence for the detrimental gender-impact of austerity policies across Europe, but they also provide readers with concrete suggestions of alternative policies that national governments and the European Union should adopt. With a combination of country case studies and cross-country empirical analysis, this book reveals the scope and channels through which women and men have been impacted by austerity policies in Europe, and goes on to offer readers the opportunity to assess the feasibility and implications of a feminist alternative to continued austerity. This book will be invaluable to social science students and researchers, as well to as policy-makers searching not just for a Plan B to continued austerity policies but for a Plan F – a feminist economic strategy to stimulate sustainable economic recovery.

Available in PDF, EPUB and Kindle. Book excerpt: This open access book presents and discusses current issues and innovative solution approaches for land management in a European context. Manifold sustainability issues are closely interconnected with land use practices. Throughout the world, we face increasing conflict over the use of land as well as competition for land. Drawing on experience in sustainable land management gained from seven years of the FONA programme (Research for Sustainable Development, conducted under the auspices of the German Federal Ministry of Education and Research), the book stresses and highlights co-design processes within the “co-creation of knowledge”, involving collaboration in transdisciplinary research processes between academia and other stakeholders. The book begins with an overview of the current state of land use practices and the subsequent need to manage land resources more sustainably. New system solutions and governance approaches in sustainable land management are presented from a European perspective on land use. The volume also addresses how to use new modes of knowledge transfer between science and practice. New perspectives in sustainable land management and methods of combining knowledge and action are presented to a broad readership in land system sciences and environmental sciences, social sciences and geosciences. This book received the Gerd Albers Award. The prize is awarded by the International Society of City and Regional Planners (ISOCARP).

Available in PDF, EPUB and Kindle. Book excerpt: For the past two decades corporate governance reform in Europe has been guided by the ‘shareholder value’ model of the firm. That model has been discredited as one of the major causes of the financial and economic crisis. In a new book published by the ETUI an alternative approach to corporate governance is presented by members of the GOODCORP network of researchers and trade unionists. This new approach, entitled the Sustainable Company, draws on both traditional ‘stakeholder’ models of the firm and newer concerns with sustainability. The main elements of the Sustainable Company and the institutions needed to support it are presented. Key themes in the book are the need for worker ‘voice’ in corporate governance and for a binding legislative framework to promote sustainability. Individual chapters deal with the issues of worker involvement, employee shareholding, sustainability-oriented remuneration, international framework agreements, NGO-trade union relationships, reforming financial regulation and carbon taxes and emissions-trading schemes.
