Book excerpt: "Political liberalism' is a concept within political philosophy that has gained much traction since the late 20th century, but it generally fails to address adequately the moral and political grounding of liberal societies. John Rawls is usually the central figure affiliated with this concept; however, the work of Judith Shklar is a valuable and underappreciated resource in considering political liberalism. Shklar's work often is classified as political liberalism in the sense that she distinguishes questions of politics from those of ethics, religion or philosophy. Shklar differs, though, from other political liberals in her skepticism that an overlapping consensus regarding justice ever can be achieved. Her unique assertion that injustice and vice, rather than justice and virtue, must be the primary focal points of liberal theory is both illuminating and perplexing. Instead of a summum bonum, Shklar holds that the only moral basis upon which liberalism can draw is the presence of a summum malum: cruelty. She does not view the pursuit of positive ends as liberalism's main objectives. Thus liberalism, for Shklar, cannot be based on a foundation beyond its negative, or restraining, capacities. Through a close analysis of the broad spectrum of her writings, this study argues that Shklar's primary moral dictum on the avoidance of cruelty is not the sole moral grounding of her 'liberalism of fear"--And that adopting the viewpoint of Shklar's 'liberalism of permanent minorities' is a way to conceptualize this assertion. Human dignity underpins and elevates her summum malum to its place within her liberal perspective. The implications of this argument extend into the broader relationship between dignity and political liberalism, suggesting that a foundation of human dignity in fact provides for and sustains a politically liberal public order.

In Liberal Politics and Public Faith: Beyond Separation, Kevin Vallier attempts to reestablish mutual respect by developing a liberal political theory that avoids the standard liberal hostility to religious voices in public life. He claims that the dominant form of academic liberalism, public reason liberalism, is far friendlier to religious influences in public life than either its proponents or detractors suppose. The best interpretation of public reason, convergence liberalism, rejects the much-derided "privatization" of religious belief, instead viewing religious contributions to politics as a resource for liberal political institutions. Many books reject privatization, Liberal Politics and Public Faith: Beyond Separation is unique in doing so on liberal grounds.

Cosmopolitans claim that loyalty to a particular state is incompatible with universal liberal principles, which hold that we have equal duties of justice to persons everywhere, while nationalist theorists justify civic obligations only by reaching beyond liberal principles and invoking the importance of national culture. In Liberal Loyalty, Anna Stilz challenges both views by defending a distinctively liberal understanding of citizenship. Drawing on Kant, Rousseau, and Habermas, Stilz argues that we owe civic obligations to the state if it is sufficiently just, and that constitutionally enshrined principles of justice in themselves--rather than territory, common language, or shared culture--are grounds for obedience to our particular state and for democratic solidarity with our fellow citizens. She demonstrates that specifying what freedom and equality mean among a particular people requires their democratic participation together as a group. Justice, therefore, depends on the authority of the democratic state because there is no way equal freedom can be defined or guaranteed without it. Yet, as Stilz shows, this does not mean that each of us should entertain some vague loyalty to democracy in general. Citizens are politically obligated to their own state and to each other, because within their particular democracy they define and ultimately guarantee their own civil rights. Liberal Loyalty is a persuasive defense of citizenship on purely liberal grounds.

It explores the terms under which such a society may appropriately wage war against an “outlaw society” and discusses the moral grounds for rendering assistance to non-liberal societies burdened by unfavorable political and economic conditions. “The Idea of Public Reason Revisited” explains why the constraints of public reason, a concept first discussed in Political Liberalism (1993), are ones that holders of both religious and non-religious comprehensive views can reasonably endorse. It is Rawls’s most detailed account of how a modern constitutional democracy, based on a liberal political conception, could and would be viewed as legitimate by reasonable citizens who on religious, philosophical, or moral grounds do not themselves accept a liberal comprehensive doctrine—such as that of Kant, or Mill, or Rawls’s own “Justice as Fairness,” presented in A Theory of Justice (1971).

Weithman takes Rawls at his word that justice as fairness was recast as a form of political liberalism because of an inconsistency Rawls found in his early treatment of social stability. He argues that the inconsistency is best seen by identifying the threats to stability with which the early Rawls was concerned. One of those threats, often overlooked by Rawls's readers, is the threat that the justice of a well-ordered society would be undermined by a generalized prisoner's dilemma. Showing how the Rawls of "A Theory of Justice" tried to avert that threat shows that the much-neglected third part of that book is of considerably greater philosophical interest, and has considerably more unity of focus, than is generally appreciated. Weithman painstakingly reconstructs Rawls's attempts to show that a just society would be stable, and just as carefully shows why Rawls came to think those arguments were inconsistent with other parts of his theory. Weithman then shows that the changes Rawls introduced into his view between "Theory of Justice" and "Political Liberalism" result from his attempt to remove the inconsistency and show that the hazard of the generalized prisoner's dilemma can be averted after all. Recovering Rawls's two treatments of stability helps to answer contested questions about the role of the original position and the foundations of justice as fairness. The result is a powerful and unified reading of Rawls's work that explains his political turn and shows his enduring engagement with some of the deepest concerns of human life.
