Book Synopsis Ratio Decidendi: Case law by : William Hamilton Bryson
Download or read book Ratio Decidendi: Case law written by William Hamilton Bryson and published by Comparative Studies in Continental and Anglo-American Legal History. This book was released on 2006 with total page 310 pages. Available in PDF, EPUB and Kindle. Book excerpt: Although the problem of ratio decidendi concerns the essence of law and justice, very little comparative work between the Continental and Anglo-American legal systems has been done on the topic. Legal literature often repeats that it is one of the sharpest points of contrast between the two legal cultures. Within the English speaking legal system, multiple opinions, both concurring and dissenting, prevail where dissent among Continental judges only occurs behind closed doors: the published decision indeed is always presented as the single and incontestable opinion of the whole court. Historical reasons are generally put forward to explain that contrast. Where in the Anglo-American Common Law system judges are asked - and always have been asked - to present the materials and reasons upon which they based their judicial opinions, in Ancien Regime continental Europe it was not considered necessary to formulate the reasons of a decision and in most courts of the European Continent it was even formally forbidden to the judges, until the end of the eighteenth century, to write down or even communicate orally "the secrets of their discussions and deliberations". To comparatists, this reveals two different cultures among judges and lawyers. In Continental Europe there is much emphasis on the idea of judging as a science which can be learned and reproduced with an impersonal rigour. The Anglo-American judge is not considered to be such a trained scientist, he is merely a practised craftsman. Can the history of ratio decidendi - but also the history of law and justice from the Middle Ages to the nineteenth century - therefore be reduced to a total contradiction between two legal cultures?

Download or read book Fauvel Studies written by Margaret Bent and published by . This book was released on 1998 with total page 768 pages. Available in PDF, EPUB and Kindle. Book excerpt: The manuscript Paris, Bibliothe'que Nationale, fonds francais 146, one of the most sumptuous and important of the fourteenth century, stands as an unparalleled witness to the politics, society, and culture of the French royal court in the early fourteenth century. It contains an interpolated version of the Roman de Fauvel, completed by Gerve's de Bus in 1314, that uniquely combines the Old French text with music setting poetry in French and Latin, high-quality illuminations (including early depictions of the architecture of medieval Paris), and further literary elaborations and additions. The narrative finds a place within several literary traditions, serving both as a satire on a fallen minister, Philip IV (d. 1314), Enguerran de Marigny, and as admonition or advice for the new King Philip V (crowned 1317). Alongside the Roman de Fauvel, fr. 146 also includes French and Latin narrative dits (the latter edited here for the first time), the complete known works of Jehannot de Lescurel, and an important French verse chronicle. It invites complementary works by such shoalrs in several disciplines. This volume assembles papers by leading medievalists and younger scholars in different fields that reflect a period of interchange and collaboration viewing the same material from different perspectives. It is generously illustrated and includes essential new reference material for medievalists in political, social, and urban history, art and architecture history, musicology, the history of the book and codicology, and medieval languages and literatures, principally Old French and Latin. This interdisciplinary collection presents a wealth of new material for medievalists working in a number of fields.
Book Synopsis The Reign of Philip the Fair by : Joseph R. Strayer
Download or read book The Reign of Philip the Fair written by Joseph R. Strayer and published by Princeton University Press. This book was released on 2019-03-26 with total page 476 pages. Available in PDF, EPUB and Kindle. Book excerpt: The reign of Philip the Fair marks both the culmination of the medieval French monarchy and the beginning of the transition from the medieval to the modern period. In this long-awaited study of Philip's reign, Joseph R. Strayer discusses the king's personality, his quarrels with the Church and with neighboring rulers, and his relations with his subjects. He also examines developments in the French administrative system. In studying the decision-making process and the careers of hundreds of royal officials, the author determines how increases in royal power and in the effectiveness and complexity of the administration were achieved. He also considers how these changes affected the possessing classes and how Philip made them acceptable or at least tolerable to the politically conscious segment of the population. As Professor Strayer shows, under Philip, the balance of loyalty swung away from the local authorities and the Church Universal and toward the secular, sovergein state. the central administration grew so strong, and its efficiency so improved, that it became the model for many other European states. Joseph R. Strayer retired from Princeton University as Dayton-Stockton Professor of History in 1973. He is the author of numerous books and articles, including On the Medieval Origins of the Modern State and Medieval Statecraft and the Perspectives of History (both Princeton books). Originally published in 1980.
