A tese se concentra especialmente no fato gerador e tipo. Desenvolveu-se no Brasil a teoria do tipo cerrado no Direito Tributário. Tratou-se do tipo como conceito determinado. A doutrina reformulou o tipo como categoria lógica, naturalmente aberto. Entretanto, seguiu a defesa da legalidade estrita. Atualmente, a doutrina e a jurisprudência começam a defender o tipo normativo aberto e o tipo como concretização de direitos. A tese começa pela análise do Direito Tributário, como disciplina autônoma. Questionam-se os limites da autonomia didática. Retoma-se o debate da autonomia científica. A partir da análise histórica e epistemológica do fato gerador, polemiza-se a legalidade estrita. Analisa-se as diversas definições de fato gerador e sua característica fluida (fattispecie). A tese propõe a identificação do fato gerador com o tipo. Cuida-se de definir os elementos comuns entre conceito e tipo. Estuda-se as fontes doutrinárias do tipo para chegar ao tipo tributário. Parte a pesquisa para aferição da aplicação hermenêutica. Conclusão: a nova feição da obrigação tributária. Propõem-se: a) a limitação da tipicidade pelo princípio da igualdade e da capacidade contributiva; b) adoção do tipo como sinônimo de fato gerador ou hipótese de aplicação.
