Trata-se de norma que impõe uma série de amarras e sujeições à Administração Pública, direcionando toda e qualquer atividade administrativa em prol da tutela do interesse público. O fenômeno da consensualização do direito administrativo traz uma nova roupagem para essa temática. De um lado, há quem entenda que não há mais sentido em se falar em indisponibilidade do interesse público em um momento no qual a Administração Pública utiliza, cada vez mais, instrumentos consensuais e de parcerias com os particulares para atingir seus objetivos. Por outro, ainda existe a defesa de que, em razão da indisponibilidade, seria vedado ao Poder Público realizar esses atos negociais. O presente livro analisa exatamente a relação entre o princípio da indisponibilidade do interesse público e a consensualidade no direito administrativo, buscando demonstrar que a indisponibilidade, além de continuar sendo uma norma que confere significado a todo o direito administrativo, não apenas não contrasta com a consensualidade como, inclusive, pode muitas vezes exigir que, preenchidos determinados requisitos, a Administração Pública opte pela via do diálogo e do consenso como melhor forma de tutelar o interesse público.
