A partir da análise dos dados, foi possível verificar que 100% dos artigos apontam o pluralismo jurídico como fato social e, portanto, o direito não pode ser estático, mas sim acompanhar as diversidades e as mais variadas formas de viver da sociedade. No Brasil, destacamos o pluralismo comunitário-participativo, que implica em uma mudança sociológica de mitigação da absoluta exclusividade do Estado, possibilitando assim uma alternativa emancipatória dos excluídos e o efetivo acesso à justiça para garantia dos direitos humanos. Além disso, o fortalecimento dos movimentos sociais, entre eles: associações, sindicatos, agremiações, centros sociais etc., como entidades efetivamente representativas e legítimas, concretizaria o sentido real de um pluralismo jurídico comunitário-participativo, contribuindo para a formação de um direito emancipatório através da inserção e participação da comunidade no mundo jurídico, aplicando o direito de maneira mais justa, aproximando-o da realidade comunitária e possibilitando maior acesso à justiça e garantia dos direitos fundamentais dos sujeitos coletivos.

É fundamental levantar toda uma trajetória sociocultural, econômica, política e jurídica para a formulação da hipótese desenvolvida, no contexto histórico em evolução, mostrando as carências e a redefinição de valores e princípios organizadores das instituições básicas e buscando as soluções compatíveis com a práxis social. Esse resgate visa o atendimento das reivindicações feitas pelos novos atores, em face das novas demandas e interesses dos grupos, classes, organizações e dos excluídos de uma maneira geral.

A comparative perspective that takes into account different political transitions – and their legal consequences – in Europe and Latin America complements the analysis. Part 1 (4 essays) discusses some of the central issues of political transition and legal history in contemporary Brazil, focusing on the time of the transition (and its effects on transitional justice) with different perspectives, from racial and gender issues to constitutional reform and police repression. Part 2 (3 essays) brings the comparative studies on South American experiences. Part 3 (4 essays) analyses different cases of transition to democracy in Chile, Portugal, Spain and Italy.
