Book Synopsis Prosecutorial Accountability and Victims' Rights in Latin America by : Verónica Michel
Download or read book Prosecutorial Accountability and Victims' Rights in Latin America written by Verónica Michel and published by Cambridge University Press. This book was released on 2018-01-18 with total page 247 pages. Available in PDF, EPUB and Kindle. Book excerpt: The responsibility of any state is to protect its citizens. But if a state, either through omission or commission, fails to investigate and prosecute crime then what remedies do citizens have? Verónica Michel investigates procedural rights in Chile, Guatemala, and Mexico that allow citizens to call for the appointment of a private prosecutor to initiate criminal investigations. This right diminishes the monopoly of the state over criminal prosecutions and thus offers citizens a way of insisting on state accountability. This book provides the first full-length empirical study of how the victims' right to private prosecution can impact access to justice in Latin America, and shows how institutional and legal arrangements interact to shape the politics of criminal justice. By examining homicide cases in detail, Michel highlights how everyday legal struggles can help build the rule of law from below.

Book Synopsis Tax and Robotics by : Álvaro Falcón Pulido
Download or read book Tax and Robotics written by Álvaro Falcón Pulido and published by BRILL. This book was released on 2023-12-18 with total page 193 pages. Available in PDF, EPUB and Kindle. Book excerpt: We are standing on the threshold of the robotic era, the fourth industrial revolution. The undeniable impact and consequences of robotics are already raising economic concerns, such as the loss of income tax revenue as robots gradually replace human workers, as well as legal doubts regarding the possible taxation of robots or their owners. Financial law must adapt to this new reality by answering several crucial questions. Should robots pay taxes? Can they? Do they have the ability to pay? Can they be considered entrepreneurs for VAT purposes? These are just some of the many issues that Dr. Álvaro Falcón Pulido lucidly and insightfully addresses in this fascinating new monographic work, which includes an exhaustive bibliography on the subject.
Book Synopsis Challenges for Human Rights by : Fernando Falcón y Tella
Download or read book Challenges for Human Rights written by Fernando Falcón y Tella and published by Martinus Nijhoff Publishers. This book was released on 2007 with total page 153 pages. Available in PDF, EPUB and Kindle. Book excerpt: Nowadays we are fortunate enough to be experiencing a boom in human rights - an enormous increase of their importance in the international sphere at all levels (political, economic, social, legal and moral). For the first time the condition of the individual as "citizen," and not just as "subject," has gained importance. Individuals, and not only states, have now become the subjects of international law, as a result of the boom in humanitarian law and international criminal law. However, although there have been many battles won and goals met concerning human rights, the war against injustice continues and the fight has not ended. It is necessary to stay alert and to avoid a potentially paralyzing self-complacency. This collection focusses on topics that are particularly relevant for the present era. It examines issues such as multiculturalism, globalization, international criminal justice (specifically third and fourth generation rights) and, within this thematic framework, the problems that have come about as a result of the expanding reach of the Internet and of new biomedical advances. In addition, it explores the increasingly urgent challenge of how to respond to international terrorism, in view of worldwide events since September 11, 2001, and its resulting aftermath. Originally published in Spanish, this thought-provoking collection will be of interest to human rights scholars and practitioners alike.
