Book excerpt: The Royal Financial Administration and the Prosecution of Crime in France, 1670–1789 explores the French monarchy’s role in financing criminal prosecutions in the royal courts of the realm—the payment of criminal frais de justice in the vocabulary of the ancien régime—between 1670 and 1789 (that is, from the codification of criminal judicial procedure in the early period of Louis XIV’s personal rule to the outbreak of the French Revolution). The subject brings together three areas of scholarly inquiry—criminal justice, royal administration, and the management of the crown’s finances. A central goal of the study is to provide factual information and interpretive insights on each of these topics and to explain the relationship of each to the others over a long time period. The book contributes to existing scholarship in four ways. First, although each of the major dimensions of the inquiry—the operation of the criminal justice system, the conduct of the royal administration, and the management of the monarchy’s finances—has a large and increasingly sophisticated historical literature, this is the first study to combine them in a systematic way. Second, the long time period covered in the book not only enables the historian to distinguish gradual from rapid change, but it also allows the reader to view how the system functioned in different historical contexts. Third, the study is based on archival sources throughout France. This comprehensive approach permits the identification of elements of a common experience without sacrificing attention to important aspects of regional diversity. Finally, with respect to the sources themselves, the range is broad, encompassing regulatory acts and decisions of the king’s councils; administrative correspondence at the central, regional, and in some cases local levels; financial accounts and related papers; and court records from the major appellate courts and from several lower courts as well. An appendix of 33 tables lists figures of annual expenditure and other pertinent financial operations for each of the major financial districts of the kingdom.

Book excerpt: In contemporary political discourse, it is common to denounce violent acts as “terroristic.” But this reflexive denunciation is a surprisingly recent development. In A Genealogy of Terror in Eighteenth-Century France, Ronald Schechter tells the story of the term’s evolution in Western thought, examining a neglected yet crucial chapter of our complicated romance with terror. For centuries prior to the French Revolution, the word “terror” had largely positive connotations. Subjects flattered monarchs with the label “terror of his enemies.” Lawyers invoked the “terror of the laws.” Theater critics praised tragedies that imparted terror and pity. By August 1794, however, terror had lost its positive valence. As revolutionaries sought to rid France of its enemies, terror became associated with surveillance committees, tribunals, and the guillotine. By unearthing the tradition that associated terror with justice, magnificence, and health, Schechter helps us understand how the revolutionary call to make terror the order of the day could inspire such fervent loyalty in the first place—even as the gratuitous violence of the revolution eventually transformed it into the dreadful term we would recognize today. Most important, perhaps, Schechter proposes that terror is not an import to Western civilization—as contemporary discourse often suggests—but rather a domestic product with a long and consequential tradition.

Telling the story of naturalization from the sixteenth to the early nineteenth centuries, Unnaturally French offers an original interpretation of the continuities and ruptures of absolutist and modern citizenship, in the process challenging the historiographical centrality of the French Revolution.Unnaturally French is a brilliant synthesis of social, legal, and political history. At its core are the tens of thousands of foreign citizens whose exhaustively researched social identities and geographic origins are presented here for the first time. Sahlins makes a signal contribution to the legal history of nationality in his comprehensive account of the theory, procedure, and practice of naturalization. In his political history of the making and unmaking of the French absolute monarchy, Sahlins considers the shifting policies toward immigrants, foreign citizens, and state membership.Sahlins argues that the absolute citizen, exemplified in Louis XIV's attempt to tax all foreigners in 1697, gave way to new practices in the middle of the eighteenth century. This "citizenship revolution," long before 1789, produced changes in private and in political culture that led to the abolition of the distinction between foreigners and citizens. Sahlins shows how the Enlightenment and the political failure of the monarchy in France laid the foundations for the development of an exclusively political citizen, in opposition to the absolute citizen who had been above all a legal subject. The author completes his original book with a study of naturalization under Napoleon and the Bourbon Restoration. Tracing the twisted history of the foreign citizen from the Old Regime to the New, Sahlins sheds light on the continuities and ruptures of the revolutionary process, and also its consequences.
