Custody of child may be immediate. If it appears from the petition that the child is embraced within subdivision one Of the first section Of this article, or is in such condition or surroundings that the welfare Of the child requires that its custody be immediately assumed, the court may endorse or cause to be endorsed upon the summons a direction that the officer serving the same shall at once take such child into custody. In the case Of any child who has been taken into custody or pending the final disposition of any case, the child may be released in the custody Of a parent or other person having charge Of the child Or in the custody Of a proba tion Officer or other person appointed by the court, to be brought before the court at the time designated. Any child embraced in this article may be admitted to bail as provided by law. When not released as herein provided such child, pending the hearing Of the case, shall be detained in such place Of detention as hereinafter provided for. C. S. 5046. Service of summons. Service Of summons shall be made personally by reading to and leaving with the persons summoned a true copy thereof: Provided, that if the court is satisfied that reasonable but unsuccess ful effort has been made to serve the summons personally upon any Of the parties named therein, or if it shall appear to the satisfaction Of the court that it is impracticable to serve a summons personally upon any of them, the court may make an order providing for service Of the summons by registered mail or by publication or otherwise in such manner as the judge Shall deter mine. It Shall be sufficient to confer jurisdiction if service is effected at any time before the time fixed in the summons for the return thereof, but the court, if requested by the child or a parent, or in case there is no parent, by the person having the guardianship, custody or supervision Of the child, shall not proceed with the hearing earlier than three days after the service. Fail ure to serve a summons upon any person other than said child shall not impair the jurisdiction Of the court to proceed in cases arising under subai vision one Of the first section of this article, provided that for good cause Shown the court shall have made an Order dispensing with such service. He focuses on miscegenation, rape, incest, child custody, and adoption laws to show how southerners struggled with the conflicts and stresses that surfaced within their own households and in the larger society during the Civil War era. Based on literary as well as legal sources, Bardaglio's analysis reveals how legal contests involving African Americans, women, children, and the poor led to a rethinking of families, sexuality, and the social order. Before the Civil War, a distinctive variation of republicanism, based primarily on hierarchy and dependence, characterized southern domestic relations. This organic ideal of the household and its power structure differed significantly from domestic law in the North, which tended to emphasize individual rights and contractual obligations.
