Then, a section on nature and conservation management covers protection of natural and cultural resources such as monuments, landscapes, parks and reserves, wildlife, agriculture, forests, fish, subsoil, and minerals. Further treatment includes the application of zoning and land-use planning, rules on liability, and administrative and judicial remedies to environmental issues. There is also an analysis of the impact of international and regional legislation and treaties on environmental regulation. Its succinct yet scholarly nature, as well as the practical quality of the information it provides, make this book a valuable resource for environmental lawyers handling cases affecting Norway. They are among the most homogeneous and hence most comparable societies in Europe. They first consider conceptions of the environment, before comparing both between and within these countries. The traditions and institutions presented in the volume reflect the comprehensiveness of the approaches used within the field in the Nordic countries.

Available in PDF, EPUB and Kindle. Book excerpt: Available online: https://pub.norden.org/temanord2023-522/ Environmental permitting procedures have been in the focus of the public debate in all the Nordic countries for some years, leading us to perform a study comparing the decision-making procedures in the five Nordic countries. We focused on two scenarios for starting and changing industrial activities. First, we describe environmental law, the permit procedure and system for supervision and enforcement in each country. Thereafter, highlights are presented from two workshops with representatives from the administrations and different stakeholders in our countries. The discussion focuses on whether the environmental permitting systems are integrated or divided into different procedures, case processing time, time limited or 'eternal' permits, changes in given permits and the relation between the permitting body and the supervising and enforcing authorities of the regulation in given permits.

Available in PDF, EPUB and Kindle. Book excerpt: Recently, the Nordic countries have experienced a rapid growth in numbers of visitors. At some popular nature attractions this has resulted in crowding, environmental damage, costly rescue operations and overload on public infrastructure. Implementation of economic policy instruments have hence been suggested to secure a more sustainable development. While the applicability of e.g. entrance fees is restricted by the public rights of access, economic instruments tend to represent short-sighted solutions. Sustainable development requires holistic policies, which take environmental, social and economic aspects into consideration in a long-term perspective. To achieve a more sustainable development of tourism, it is suggested that a limited use of economic instrument should take place in combination with adaptive management strategies and available legal and administrative instruments.

The cases cover varying themes and conflicts between interests and provides an overview of different considerations that are at stake when planning and balancing land use. Through a mapping of different strategies and policy instruments affecting land use planning, PlanMiljø have compiled recommendations on how to improve the process of land use planning to avoid conflicts between stakeholders.

Book excerpt: Natural and cultural heritage represent key assets that deliver different kind of benefits to citizens in the Nordic countries. This report illustrates the economic values at stake and discusses the important and inevitable key trade-offs facing decision-makers charged with managing these assests. The report has three goals: to briefly describe existing conservation measures in the Nordic countries, to illustrate the type and magnitude of economic values generated by these measures, and to discuss key trade-offs and policy implications arising from the selection of measures, which lead to welfare impacts depending on the level of human use. The valuation studies reviewed in the report demonstrate real economic values associated with the experiences that natural and cultural heritage provides both in terms of increased welfare and regional economic impacts.

Available in PDF, EPUB and Kindle. Book excerpt: From fisheries to persistent organic pollutants to climate change itself, no other environmental principle in environmental law has produced as much controversy as the precautionary principle. Unlike a preventive approach in which action is taken provided that the threats to the environment are tangible, with a precautionary approach, authorities are prepared to tackle risks for which there is no definitive proof that the damage will materialize. The ramifications of this increasingly apparent approach are profound and cut across all areas of risk assessment and management, environmental law, policy and regulation in every major sector. However, to date little thought has been dedicated to the implementation of the precautionary principle in a wide array of environmental circumstances. This authoritative handbook addresses the legal aspects of how the precautionary principle is implemented in different sectors, and examines its successes, failures, strengths and weaknesses. Sectors and subjects covered include chemicals, GMOs, marine pollution, fisheries and nature conservation, and the book draws on cases in the EU, in the USA, and Nordic countries, where the use of precaution has been gathering momentum. Ultimately, the book provides an indispensable appraisal of the question - increasingly important in the era of human-induced climate change - of whether the precautionary principle is relevant, indeed essential, to avert major environmental and health risks, and how and when it can be used successfully.
