Razões práticas, como as relativas à dimensão crescente da obra, forçam-nos a deixar por aqui o anterior projecto. A partir de agora, só a realidade portuguesa será contemplada: tal como a próxima edição brasileira só contemplará o sistema respectivo. As referências ao direito do outro país serão consideravelmente abreviadas e limitar-se-ão, salvo necessidade particular, a simples notas. Temos pena. A origem comum dos sistemas jurídicos e a mentalidade jurídica tão próxima dos povos convidavam ainda a outros aprofundamentos e a novas descobertas recíprocas. Não desistimos de o tentar empreender, como temos feito aliás em vários outros sectores. Mas deixou de constituir objectivo específico deste livro. O próprio título é alterado. A versão brasileira passará a designar-se Introdução à Ciência do Direito. E a versão portuguesa perde o subtítulo Uma Perspectiva Luso-Brasileira. Prosseguirá o trabalho de aprofundamento e de actualização face à tão meteórica variação dos fundamentos jurídicos e do circunstancialismo global dos dois países. Resta-nos em qualquer caso a esperança que a semente de conhecimento e reflexão mútuos que foi lançada continue a germinar e se robusteça como património comum. The global commons have always been understood as geographical spaces that exist only outside the political borders of states. A vital good such as a stable climate exists both within and outside all states, and shows traditional legal approaches to be ecological nonsense. With the recent possibility of measuring and monitoring the state and functioning of the Earth System through the Planetary Boundaries framework, it is now possible to define a “Safe Operating Space of Humankind” corresponding to a biogeophysical state of Earth. In this sense, the Common Home of Humanity is not a planet with 510 million square kilometres, but is a specific favourable state of the Earth System. Recent major scientific advances anticipate a legal paradigm shift that could overcome the disconnection between ecological realities and existing legal frameworks. If we recognize this qualitative and non-geographic space as a Common Natural Intangible Heritage of Humankind, all positive and negative “externalities” end up being included within a new maintenance system of the Common Home.

Book excerpt: As European colonies in Asia and Africa became independent nations, as the United States engaged in war in Southeast Asia and in covert operations in South America, anthropologists questioned their interactions with their subjects and worried about the political consequences of government-supported research. By 1970, some spoke of anthropology as “the child of Western imperialism” and as “scientific colonialism.” Ironically, as the link between anthropology and colonialism became more widely accepted within the discipline, serious interest in examining the history of anthropology in colonial contexts diminished. This volume is an effort to initiate a critical historical consideration of the varying “colonial situations” in which (and out of which) ethnographic knowledge essential to anthropology has been produced. The essays comment on ethnographic work from the middle of the nineteenth century to nearly the end of the twentieth, in regions from Oceania through southeast Asia, the Andaman Islands, and southern Africa to North and South America.
