Book excerpt: "Much of the attention paid to native title in Australia has focused on court proceedings and other legalities, but what does it actually mean to live with native title? This book presents the experiences of native title holders and the corporations they have established to look after their native title interests. The influence of the renowned High Court 'Mabo' case is such that there are already more than 100 Registered Native Title Bodies Corporate (RNTBCs) across Australia with responsibilities for about 18 percent of the continent. RNTBCs operate in a profoundly intercultural context, where "western" and indigenous laws are constantly interpreted and negotiated as part of generating a new suite of landholding and land management practices for contemporary Australia. Through seven case studies from the Torres Strait, Far North Queensland, the Kimberley and Central Australia, 'Living with native title' documents their experiences as well as the experiences of native title corporations that are parties to large mining agreements. Each case study is accompanied by a short update written immediately prior tp publication. The introductory chapters provide further information on the RNTBC regime and the RNTBC review and reform process, and other findings from AIATSIS's long-term research with PBCs. 'Living with native title' is the outcome of a three-year AIATSIS research project in partnership with the Minerals Council of Australia and the Office of the Registrar of Indigenous Corporations, with funding from the Department of Families, Housing, Community Services and Indigenous Affairs. Book excerpt: In recent decades, various forms of co-management of national parks and other protected areas by governments and Indigenous people have come to the fore. This has occurred as Indigenous peoples have progressively demanded greater access to and decision-making power over their traditional lands. The response of governments has also seen the aligning of a number of policy approaches that have contributed to an increase in attention to co-management. In this paper, we are concerned with the regulatory and non-regulatory formal institutions defined by Maclean et al. (2012: 21) as the rules, regulations and social norms that are formalised in conventions, strategies, policy and plans that frame the entrance to co-management arrangements. The paper first provides an overview of these institutions in Commonwealth, state and territory jurisdictions, and discusses a number of evolving pathways to co-management in Australia, in particular native title. It then makes some jurisdictional comparisons of these institutional arrangements, questioning their relative value and whether their diversity is creating significant inequities among Aboriginal people.

Book excerpt: It is gradually being recognised by both Indigenous and non-Indigenous Australians that getting contemporary Indigenous governance right is fundamental to improving Indigenous well-being and generating sustained socioeconomic development. This collection of papers examines the dilemmas and challenges involved in the Indigenous struggle for the development and recognition of systems of governance that they recognise as both legitimate and effective. The authors highlight the nature of the contestation and negotiation between Australian governments, their agents, and Indigenous groups over the appropriateness of different governance processes, values and practices, and over the application of related policy, institutional and funding frameworks within Indigenous affairs. The long-term, comparative study reported in this monograph has been national in coverage, and community and regional in focus. It has pulled together a multidisciplinary team to work with partner communities and organisations to investigate Indigenous governance arrangements-the processes, structures, scales, institutions, leadership, powers, capacities, and cultural foundations-across rural, remote and urban settings. This ethnographic case study research demonstrates that Indigenous and non-Indigenous governance systems are intercultural in respect to issues of power, authority, institutions and relationships. It documents the intended and unintended consequences-beneficial and negative-arising for both Indigenous and non-Indigenous Australians from the realities of contested governance. The findings suggest that the facilitation of effective, legitimate governance should be a policy, funding and institutional imperative for all Australian governments. This research was conducted under an Australian Research Council Linkage Project, with Reconciliation Australia as Industry Partner.
