The purpose of this report is to overview the NPS situation in Europe today and to highlight emerging threats to support early warning, preparedness planning and response measures. In addition, 16 June 2022 marks 25 years since legislation was adopted in the EU allowing it to rapidly react to threats caused by NPS (Council of the European Union, 1997). Since then, the market has undergone periods of significant growth and change. The anniversary provides an opportunity to reflect on these changes and the lessons learned. This will help inform the direction of work and policy so that the EU remains prepared and at the forefront of the response to NPS, helping protect public health.

Book excerpt: With nearly 300 new psychoactive substances (NPS) reported to the EU’s early warning system in the 2013-2015 period, the evolution of the European market for NPS has accelerated to a speed that the public authorities’ established response - drug control laws - has struggled to match. Varying legal responses have been introduced in different countries, whether: by using existing laws that focused on consumer or health protection or medicinal products; by modifying drug laws to introduce group definitions of substances under control; or by developing innovative new legislation. Use of medicinal product laws - which are based on an EU directive - was challenged in the Court of Justice of the European Union (CJEU), which ruled in 2014 that substances are not medicinal products if they do not have beneficial effects on human health. As a result, Eurojust and the European Monitoring Centre for Drugs and Drug Addiction (EMCDDA) were called upon to consider challenges for judicial cooperation and explore creative solutions to address the problems related to the prosecution of non-controlled NPS. The first part of this joint report is aimed at policymakers. It lists four challenges in NPS control, and then describes the different legislative solutions used in many of the Member States. Focusing on the innovative new laws that are designed to address the issue, the report gives the reader a breakdown of their key elements: the criteria used to define NPS; the systems for listing them; and the penalties for non-compliance. The second part of the report is aimed at legal practitioners. It outlines the NPS judgment of the CJEU and its practical effects on transnational prosecution of NPS cases, and describes the responses of some of the Member States most affected by the ruling. Combining the top-level monitoring activities of the EMCDDA with the operational experience of Eurojust in transnational prosecutions, this joint report aims to provide succinct but useful information to the key actors in this area.

Definition of “NPS” includes any substance that has recently become available and has been designed purposely to replace illegal drugs, although not necessarily of new synthesis. Use of NPS is dramatically increased in the last decade and represents a serious risk for the public health. Their ever-evolving chemical structure, the possibility to distribute in real time through the Internet and social networks information about their use and effects have dramatically challenged public health and drug policies internationally. NPS recently attracted great attention, but most are still unregulated and proposed online as legal alternatives to traditional illicit drugs. Unfortunately, this area is still poorly investigated and very limited information are available so far on their nature and potential risks. The phenomenon of NPS requires multi-national and multi-disciplinary collaborations to improve our knowledge on this changing drug market, to share information and define good practices at a global level. Political and educational efforts are indispensable to regulate this mutable scenario and to inform the public about health consequences of NPS use. Clinicians and emergency staff should be aware that NPS may cause severe health consequences and unexpected adverse effects, and be informed on how to recognized and treat specific intoxication cases. Considering the widespread use of NPS and paucity of information about their toxicology and pharmacology, this Research Topic will be useful to understand the new trends in the scenario of drug use, abuse and addiction to inform professionals and general public about the health problems caused by NPS and to help drug-control policies to adopt suitable control measures.

The question remains open, however, as to which structures and bodies can better serve single policies or an integrated policy for all substances.
