Demands for peace, democracy, accountability and development, have abounded in the post-conflict context. Although the conflict catalysed major changes in the social and political landscape in Nepal, the transitional justice (TJ) process has remained deeply contentious and fragmented. This book provides an in-depth analysis of transitional justice process in Nepal. Drawing on interviews with a diverse range of stakeholders, including victims, ex-combatants, community members, human rights advocates, journalists and representatives from diplomatic missions, international organisations and the donor community, it reveals the differing viewpoints, knowledge, attitudes and preferences about TJ and other post-conflict issues in Nepal. The author develops an actor typology and an action spectrum, which can be used in Nepal and other post-conflict contexts. The actor typology identifies four main groups of TJ actors—experts, brokers, implementers and victims—and highlights who is making claims and on behalf of whom. The action spectrum, based on contentious politics literature and resistance literature, demonstrates the strategies actors use to shape the TJ process. This book argues that the potential of TJ lies in these dynamics of contention. It is by letting these dynamics play out that different conceptualisations of TJ can arise. While doing so may lead to practical challenges and produce situations that are normatively undesirable for some actors, particularly when certain political parties and national actors seem to ‘hijack’ TJ, remaining steadfast to the dominant TJ paradigm is also undesirable. As the first book to provide a single case study on TJ in Nepal, it makes theoretical and empirical contributions to: TJ research in Nepal and the Asia-Pacific more broadly, the politics versus justice binary and the concept of victimhood, among others. It will be of interest to a wide range of scholars in the study of transitional justice, peace and conflict studies, human rights, sociology, political science, criminology, law, anthropology and South Asian Studies, as well as policy-makers and NGOs.

Book excerpt: Security sector reform (SSR) and transitional justice processes often occur alongside each other in societies emerging from conflict or authoritarian rule, involve many of the same actors, are supported by some of the same partner countries and impact on each other. Yet the relationship between SSR and transitional justice, or “dealing with the past” (DwP) as it is also called, remains underexplored and is often marked by ignorance and resistance. While SSR and transitional justice processes can get into each other’s way, this paper argues that SSR and DwP are intrinsically linked and can complement each other. SSR can make for better transitional justice and vice versa. Transitional justice needs SSR to prevent a recurrence of abuses, an essential element of justice. SSR can learn from transitional justice not only that it is better to deal with rather than ignore an abusive past but also how to address an abusive legacy in the security sector. The validity of these assumptions is tested in two case studies: the police reform process in Bosnia and Herzegovina after 1995 and the SSR process in Nepal after 2006.

Book excerpt: This book examines international military interventions that have supported stability in four communities in Afghanistan and Nepal, in an attempt to analyse their success and improve this in future. This is the first in-depth village-level assessment of how local populations conceive of stability and stabilisation, and provides a theory and model for how stability can be created in communities during and after conflict. The data was collected during field research from 2010-12. In Afghanistan the conflicts examined include the invasion of the Soviet Union in 1979, the civil war from 1992 and the rise and fall of the Taliban. In Nepal the research examined the origins of the Maoist movement and the start of the People’s War in 1996 to its completion in 2006 and the subsequent Madeshi Andolan in 2007. The book argues that international, particularly Western, notions of stability and stabilisation processes have failed to grasp the importance of local political legitimacy formation, which is a vital aspect of contemporary statebuilding of a ‘non-Westphalian’ nature. The interventions, across defence, diplomatic and defence lines, have also at times undermined one another and in some cases contributed to instability. The work argues that the theories that structure interventions to address threats to international stability in ‘fragile’ states are insufficient to explain or achieve the goal of stability. This book will be of interest to students of stabilisation operations, statebuilding, peacebuilding, counterinsurgency, war and conflict studies and security studies in general. Christian Dennys is lecturer at Cranfield University/UK Defence Academy and has a PhD in International Relations.
