Book excerpt: O trabalho elaborado tem como propósito estudar as relações de trabalho, em especial, quanto à possibilidade de flexibilização dos direitos trabalhistas por meio de norma coletiva sob a perspectiva constitucional, observando os princípios da dignidade da pessoa humana, da proteção e da norma mais favorável. Mormente, é necessário um estudo para elucidar a criação, evolução e estruturação desse ramo autônomo do direito como um objeto, a priori, como fonte de aumento da condição social do trabalhador e a forma como, atualmente, deturpou-se para utilização de maneira a relativizar as relações de trabalho, tornando-se possível a flexibilização de direitos por meio de normas coletivas. Nesse aspecto, citamos a forte corrente neoliberal que foi capaz de desconstruir um paradigma histórico das relações de trabalho, a proteção do trabalhador e trazer o uso indiscriminado do instituto da prevalência do negociado sobre o legislado como modo de flexibilização de diretos dos trabalhadores. Por fim, avalia-se a perspectiva constitucional da nova interpretação sobre a flexibilização das normas trabalhistas, em especial, a prevalência do negociado sobre o legislado com relação aos princípios da dignidade da pessoa humana e ao princípio da proteção ao trabalhador, dentro da dinâmica da máxima eficácia dos direitos fundamentais e qual o papel que o poder judiciário poderia exercer.

Nesse sentido, a partir dos dados disponíveis no banco de informações dos Ministérios do Trabalho do Brasil e da Argentina, será analisado se o processo de descentralização das negociações que tem ocorrido em ambos os países vem cumprindo o papel de legitimação da flexibilização das normas trabalhistas, introduzidas na década de 90, nestes países. As transformações que ocorreram na economia mundial, a partir da maior liberalização comercial e integração econômica dos países, intensificaram a competição levando as empresas a reestruturarem sua organização produtiva com profundos reflexos sobre o sistema de relações de trabalho. Enquanto fenômeno geral há em curso um processo de internalização nas empresas das definições das normas e das relações de trabalho. O Estado, no intuito de promover a competitividade empresarial, vem introduzindo modificações nas normas trabalhistas e incentivando a negociação. Contudo a negociação coletiva descentralizada por empresa, se constitui no elemento chave para a legitimação da flexibilização.

Por isso mesmo, neste estudo são focadas as principais alterações havidas nos modelos empresariais de gestão e administração de pessoal, seus impactos perante as relações trabalhistas, suas conseqüências nos relacionamentos internos e sindicais e seus desdobramentos jurídicos e sociais, mais especificamente diante da atuação e intervenção da Negociação Coletiva de Trabalho dentro desse processo mutante. A Negociação Coletiva de Trabalho é analisada e estudada como instrumento de eficácia dos Direitos Fundamentais, de acordo com a sua natureza dúctil na obtenção de soluções ideais, estabelecendo-se bases sociais mínimas para convívio e estipulação de garantias, principalmente, ligadas à dignidade da pessoa humana, em especial, por meio do conceito denominado de horizontalização, ou seja, não mais somente frente ao Estado (verticalização), mas também aos particulares. Uma abordagem tópica dessas mudanças entrelinha-se com as oportunidades que surgem aos interessados, de acordo com os papéis que desenvolvem na sociedade e diante dos padrões de atuação e novas funções que passam a ser-lhes exigidas, conforme as inovações tecnológicas que se apresentam, novos tipos de contratação, terceirização e fenômenos relacionados à evolução da subordinação, poder de direção do empregador e flexibilização. Para fazer frente a essas mudanças e buscar alternativas de convívio apropriadas aos parceiros sociais, a Negociação Coletiva de Trabalho, dentro da sua composição sistêmica de atuação dialética afigura-se como mecanismo próprio e adequado de intersecção conjuntural para uma releitura de institutos e conceitos legais e sociais, de acordo com uma nova concepção, que não à toa, é designada como gramática da Negociação Coletiva de Trabalho, que se decompõe em diacronia, que é a sua análise a partir da evolução ao longo do tempo, sincronia, que é a análise do seu funcionamento num dado momento do tempo e morfologia que se concentra na formatação da sua estrutura e classificação, em especial, possibilitando a derrubada de mitos, com o reconhecimento de modelos modernos como a função social da empresa, o respeito à dignidade da pessoa humana dentro da empresa, à cidadania e à valorização social do trabalho.

Por fim, procurar-se-á identificar os pressupostos e as possibilidades para adoção do contrato coletivo frente a atual conjuntura jurídico-brasileira, como inicialmente exposto.
