Book excerpt: A must-have reference for contract management professionals, the CMBOK presents what should be learned by contract managers and how they should learn it. The content was developed through a voluntary consensus process governed and administered by NCMA to promote the fair development of consensus. This consensus was established through a job task analysis survey of contract managers and working groups comprised of subject matter experts in contract management. The CMBOK is not solely for the benefit of contract managers; contract managers are not the only ones involved in contract management activities. Numerous stakeholders measure success or failure by contract performance. Knowledge of contract management and competent contract management processes directly impacts the success of contract performance. The seventh edition of the CMBOK is primarily driven by the changes to the Contract Management Standard™ (CMS™). In June 2022, the American National Standards Institute (ANSI) reaffirmed the NCMA CMS™ as an American National Standard (ANS). This ANS [ANSI/NCMA ASD 1-2019 (R2022)—see Annex] serves as the CMBOK’s foundational document to expand, refine, and reorganize contract management knowledge. The CMBOK provides further definition of the field of contract management; the framework for the body of knowledge; and the practices, lexicon, and processes of contract management. In addition, it provides procedural steps for contract management processes in general, as well as for specialized areas, including government or commercial contracting.

Book excerpt: This thesis was an attempt to classify, analyze and summarize selected, finite bodies of contracting literature and purchasing literature. The primary objective of this thesis was to apply an existing taxonomy to recent libraries of two different publications, one representative of Government contracting and one representative of commercial purchasing. Analysis of the results of this classification effort provided conclusive information about taxonomical similarities and differences between contracting and purchasing literature in these two publications. A secondary objective of this thesis was to assess the differences in subject matter between the two journals and by extension, the differences between Government contracting literature and commercial purchasing literature. The final objective of this thesis was to compile an annotated bibliography of articles primed in the contracting journal that have not been previously annotated.

Book excerpt: The NCMA's Contract Management Dictionary provides useful information on the fundamental meaning and everyday use of more than 4,000 contracting terms from over 100 sources. This publication has greatly expanded upon our previous series, the Desktop Guide to Basic Contracting Terms, to include new and recent terms contract managers may encounter on the job. All terms and their definitions have been compiled from official sources or from publications by recognized experts in the field. Entries have been adapted and edited for content, consistency, and clarity of meaning. Where appropriate, contextual relevance has been provided. NCMA encourages using the Federal Acquisition Regulation(FAR), its agency supplements, the United States Code (U.S.C.), the Uniform Commercial Code (UCC), and other official sources for more detailed information. Source codes accompany the definitions. These have been listed with their corresponding source information in the Source Code List beginning on page 301). If a definition is not accompanied by a source code, it is considered original to this edition. The NCMA's Contract Management Dictionary serves as a training tool and on-the-job reference for both new entrants into the field and more seasoned practitioners, as well as a study tool for certification examinations. Other study manuals and resources for professional certification examinations are also available from NCMA.

Available in PDF, EPUB and Kindle. Book excerpt: The second edition of Government Contracting: Promises and Perils picks up where the first edition’s mission left off: exposing fraud, incompetence, waste, and abuse (FIWA) and analyzing corruption, mismanagement, and ineptitude that defile government contracting. The first edition thoroughly outlined procurement throughout the contracting cycle including initial planning, contractor selection, contract administration, contract closeout, and auditing. This significantly revised new edition provides additional much-needed guidance on contracting documents, management tools, and processes for addressing negative influences on government contracting, including an improved approach to evaluating proposals. Specific guidance for avoiding FIWA is provided for government officials and employees, government agencies, and government contractors, and practical solutions to problems faced by individuals and organizations involved in government contracting are intended for both practitioner and pedagogical applications. The "Government Procurement Corruption Wall of Shame" that was introduced in the first edition to illustrate contracting perils such as conflicts of interest, duplicity, favoritism, incompetence, kickbacks, and protests is continued in the second edition, and cases illustrating the existence of FIWA in government contracting have been thoroughly updated. Contracting documents and contract management tools are provided on a website designed to accompany the book. Written at the graduate level and specifically intended for state, local, federal, and international government procurement activities, this textbook is required reading for public procurement, contract management, business, and public administrations courses.

Available in PDF, EPUB and Kindle. Book excerpt: Globalization, increased economic and geopolitical uncertainty, technological advancements, and a rise in the number of regulations and legislations have led to a significant rise in the importance, volume, and complexity of modern contractual agreements. Yet, in spite of these profound changes, many organizations still manage the contracting process in a fragmented, manual, and ad-hoc manner, resulting in poor contract visibility, ineffective monitoring and management of contract compliance, and inadequate analysis of contract performance. The net effect of this has been a heightened interest in re-engineering and automation of Enterprise Contract Management (ECM) processes across industry sectors and geographies. Enterprise Contract Management: A Practical Guide to Successfully Implementing an ECM Solution addresses all the questions surrounding ECM, ECM solutions, and the project management, change management, and risk management considerations to ensure its successful implementation. This concise text will help your organization manage the challenges of the contract life cycle and the key success factors and pitfalls in a typical ECM solution. It is a must read for corporate executives, buyers, procurement and strategic sourcing specialists, contract administrators and procurement managers. There is currently no other book available on ECM solutions. All existing books on contract management focus on the legal aspects of contracts, but none describe the functions, features, capabilities of technology solutions that support ECM, nor do they explain the key considerations for ensuring a successful ECM solution implementation.

Book excerpt: Government contracting is one of the most important issues facing federal, state, and local governments. As governments contend with lower tax revenues and a growing belief that smaller government is better government, contracting has become a fundamental means of providing goods and services to citizens. This volume, which is geared toward practitioners as well as students, addresses the broad range of issues that comprise government contracting – from the political, economic philosophy, and value of contracting – to the future of government contracting. Throughout the volume academic theory provides a foundation to address practical subjects, including the contract process, monitoring and evaluating contracts, ethics, and both federal and state local government contracting. Contributors to this volume are both academicians and practitioners, who together offer their scholarly expertise and practical experience, encouraging readers to ask the very question "What is the role of government in American society?" Through this approach, students will acquire the knowledge needed to understand the various aspects of government contracting, and practitioners will enhance their public procurement skills. Government Contracting is ideally suited to MPA students, practitioners in the public sector, and elected officials looking to enhance their understanding of privatization and contracting in order to provide public services more effectively.
