The country is one of the top five oil producers. The recent resource crisis in the Niger Delta is caused by poor division of resources, underdevelopment, and mismanagement. The failure of the young democracy would have a vehement effect in the country and in Africa as a whole. The government has to consolidate its democracy, uphold unity and sovereignty. To secure democracy it will need support from the Nigerians themselves, the multinational oil companies and the international world.

Book excerpt: Master's Thesis from the year 2014 in the subject Law - Miscellaneous, grade: 1C, University of Stirling (School of Arts and Humanities - Division of Law and Philosophy), course: LLM International Energy Law and Policy, language: English, abstract: Decades of irresponsible oil exploitation in the Niger Delta have caused a water and air pollution which does not have many comparisons anywhere else. In an already fragile country as Nigeria, characterised by weak democratic institutions and poor economic governance, this situation has led to increasing discontent and violence towards both the government and the oil multinationals. These two actors co-operate for the maximisation of oil profits and revenues while, at the same time, excluding local host communities from the participation in the oil development projects, preventing them to achieve a sustainable development, violating their Human Rights, and compromising their livelihoods. This paper analyses the legal framework of Nigeria in the oil sector and the peculiarities of the country in order to provide a critical overview of the issues, demonstrating that the amendment of the domestic Acts dealing with the topic, as well as the remediation to the damages caused by the oil multinationals, are no longer deferrable. The final aim is to suggest a pattern to sustainable oil development which, by means of applying the concepts of Corporate Social Responsibility, would help to quell the conflict, to improve the standards of life of local people, and to make Nigeria emerge as a socio-environmentally responsible African resource-rich country.

Several theories of multinational enterprises were reviewed and how these theories, as well as the activities of the multinational firms, are related to the development of the Nigerian economy. Arguments put forward by different scholars were also discussed. Finally, it was recommended that for the Nigerian economy to develop, conscious actions have to be taken to move the economy from an import-dependent to an exporting economy.

Available in PDF, EPUB and Kindle. Book excerpt: Research on profit shifting by multinational corporations in developing countries is limited due to a lack of data. In this paper we use, for the first time, novel administrative data on the transactions of multinational corporations operating in Nigeria vis-à-vis related parties in other jurisdictions. The data provides a breakdown of these intra-group transactions into seven categories: (1) tangible goods, (2) services and fees, (3) royalties, (4) interest, (5) dividends, (6) reimbursements, and (7) other. We develop a methodology that uses this data to identify which transactions are most often used by multinationals to shift profits out of Nigeria and estimate their relative importance. We find that profits reported in Nigeria are highly sensitive to the hypothetical tax that would be paid on a transaction's value in the partner jurisdiction: a 1 per cent increase in the hypothetical tax on outgoing transactions is associated with a 0.28 per cent increase in reported profits in Nigeria. Payments for services and fees, royalties, and interest going from Nigerian companies to affiliates in low-tax countries are the most important channels of profit shifting in Nigeria. We argue that our approach can be used to inform low-cost policy interventions and increase audit efficiency with potentially strong effects on corporate income tax collection.
