It describes and evaluates emerging patterns of communication between a new and diverse set of speakers and their audiences. Drawing upon political theory, the book considers the extent to which the constitutional and legal frameworks of modern liberal states allow for a ‘contestatory space’ that advances the scope for non-traditional speakers to participate in policy debates and to hold elites to account.

Available in PDF, EPUB and Kindle. Book excerpt: Aaron McDuffie Moore (1863–1923) was born in rural Columbus County in eastern North Carolina at the close of the Civil War. Defying the odds stacked against an African American of this era, he pursued an education, alternating between work on the family farm and attending school. Moore originally dreamed of becoming an educator and attended notable teacher training schools in the state. But later, while at Shaw University, he followed another passion and entered Leonard Medical School. Dr. Moore graduated with honors in 1888 and became the first practicing African American physician in the city of Durham, North Carolina. He went on to establish the Durham Drug Company and the Durham Colored Library; spearhead and run Lincoln Hospital, the city's first secular, freestanding African American hospital; cofound North Carolina Mutual Life Insurance Company; help launch Rosenwald schools for African American children statewide; and foster the development of Durham's Hayti community. Dr. Moore was one-third of the mighty "Triumvirate" alongside John Merrick and C. C. Spaulding, credited with establishing Durham as the capital of the African American middle class in the late nineteenth and early twentieth centuries and founding Durham's famed Black Wall Street. His legacy can still be seen on the city streets and country backroads today, and an examination of his life provides key insights into the history of Durham, the state, and the nation during Reconstruction and the beginning of the Jim Crow Era.

Available in PDF, EPUB and Kindle. Book excerpt: ERISA, the detailed and technical amalgam of labor law, trust law, and tax law, directly governs trillions of dollars spent on retirement savings, health care, and other important benefits for more than 100 million Americans. Despite playing this central role in the US economy and social insurance systems, the complexities of ERISA are often understood by only a few specialists. ERISA Principles elucidates employee benefit law from a policy perspective, concisely explaining how common themes apply across a wide range of benefit plans and factual contexts. The book's non-technical language and cross-cutting conceptual organization reveal latent similarities and rationalize differences between the regulatory treatment of apparently disparate programs, including traditional pensions, 401(k), and health care plans. Important legal developments - whether statutory, judicial, or administrative - are framed and analyzed in an accessible, principles-centric manner, explaining how ERISA functions as a coherent whole.

Book excerpt: With contributions from over fifty architects, planners, geographers, historians, and journalists, The Arsenal offers a wide-ranging view of the forces that shape our cities. Who gets to be where? The Arsenal of Exclusion & Inclusion examines some of the policies, practices, and physical artifacts that have been used by planners, policymakers, developers, real estate brokers, community activists, and other urban actors in the United States to draw, erase, or redraw the lines that divide. The Arsenal inventories these weapons of exclusion and inclusion, describes how they have been used, and speculates about how they might be deployed (or retired) for the sake of more open cities in which more people have access to more places. With contributions from over fifty architects, planners, geographers, historians, and journalists, The Arsenal offers a wide-ranging view of the forces that shape our cities. With contributions from some of the best minds in architecture, such as Julie Behrens, Bill Bishop, Lisa Brawley, Ava Bromberg, Marshall Brown, Common Room, Charles Connerly, Nathan Connolly, Margaret Crawford, Alexander D'Hooghe, Elizabeth Evitts Dickenson, David Freund, Gerald Frug, Vincent James, Jeffrey Johnson, Michael Kubo, Kaja Kuhl, Matthew Lassiter, Amy Lavine, Setha Low, Thomas Oles, Michael Piper, Wendy Plotkin, Jenny Polak, Albert Pope, Mathan Ratinam, Brian Ripel, James Rojas, Theresa Schwarz, Roger Sherman, Susan Sloan, Lior Strahilevitz, Meredith TenHoor, William TenHoor, Thumb Projects (Graphic Design), Stephen Walker and Jennifer Yoos, among others. The authors demonstrate the big-picture role of insurance law and policy in American business and society, exploring federal-state regulatory roles in depth as well as the traditional topics covered in casebooks. The Teacher’s Manual—with case briefs, backgrounds on selected cases, simple diagrams that explain complex issues, and answers to questions and problems—is especially useful for instructors new to the course. New to the Fifth Edition: Expanded coverage of the role of insurance in disasters and catastrophes, including the COVID-19 pandemic Extensive treatment of the now-finalized Restatement of the Law, Liability Insurance Reorganization of the liability insurance chapters to facilitate more step-by-step learning Replacement of a few difficult-to-teach cases with new, more straightforward cases Professors and student will benefit from: Focus on the big picture of federal-state regulatory roles in addition to the traditional insurance coverage topics addressed in other Insurance Law casebooks Extensive use of statutory materials, with statutes typically presented through carefully-constructed problems Manageable assignments structured with one major case, informative notes, questions, and a problem Interesting, up-to-date cases, with context-setting introductions, on topics such as cyber insurance, the role of private insurance in responding to public catastrophes, and the new Restatement of the Law Liability Insurance Cases are longer, providing students better grounding in the art of extracting useful knowledge from judicial opinions Elimination of some of the arcane aspects of insurance law in favor of presenting a broad and conceptual overview of the field
