Building on the E-rate Modernization Order, the Commission adopted in July, the improvements to the program that the Commission adopts in this Order seek to close the high-speed connectivity gap between rural schools and libraries and their urban and suburban counterparts, and provide sufficient and certain funding for high-speed connectivity to and within all eligible schools and libraries. The Commission takes these actions to ensure the continued success of the E-rate program as it transitions from supporting legacy services to focusing on meeting the high-speed broadband connectivity needs of schools and libraries consistent with the recently adopted program goals and long-term connectivity targets. In the Order on Reconsideration, the Commission grants in part the petitions for reconsideration of the areas designated as urban for purposes of the E-rate program. The Commission also denies petitions for reconsideration of the document retention period, the phase out of support for telephone components and other services, and funding commitments that cover multiple years. At the same time, the Commission clarifies our cost effectiveness test for individual data plans and the cost allocation rules for circuits carrying voice services. We deny a request to reconsider which 12 months of revenues will be considered for purposes of defining Eligible Recovery. Finally, we deny a request to reconsider the use of tariff forecasts for calculating the baseline for rate-of-return carriers. Book excerpt: The Federal E-rate program was established in 1996 as part of a broad effort to bring high-speed Internet access to schools and libraries around the country, particularly in rural areas. Under the program, schools and libraries can receive grants which cover up to 90% of their Internet service and telecommunications costs. Funding for the program comes from “Universal Service Fees” assessed on telecommunications services. The program is regulated by the Federal Communications Commission (FCC), but is administered by the Universal Service Administrative Company (USAC), a federally chartered, non-profit corporation.The $2.5 billion program is considered a success. USAC processes over 35,000 applications per year for new and continuing E-rate support. Statistics from 2002 (the most recent year available) show that 99% of public schools and 92% of public school classrooms have Internet access, with much of that access being through broadband connections funded in part by the E-rate program. Until recently, the only significant glitch in the program was the Children's Internet Protection Act (see, Living in a Post-CIPA World, Information Today, September 2003), which added a requirement that all public school and library E-rate recipients must install and use filtering software on their Internet accessible computers.Recently, however, a more significant series of glitches has ground the program to a halt. In August, 2004, the FCC ordered a number of changes in the accounting, disbursement and audit practices of both the FCC and the USAC. Complications ensued.

Book excerpt: Passage of the Telecommunications Act of 1996 (P.L. 104-104) codified the long standing policy commitment to ensure universal service in the provision of telecommunications services. The 1996 Act also expanded the concept to include, among other principles, that elementary schools and classrooms, and libraries should have access to telecommunications services for educational purposes at discounted rates. The Federal Communications Commission (FCC) was tasked with implementing the universal provisions of the Act and on May 7, 1997, adopted its order detailing its guidelines.
