Book excerpt: This report examines the EU's contribution to the modernisation of European higher education, including the role of the separate Bologna Process. It calls on the Government to overcome the UK's lack of mobility culture, including by making language learning compulsory in primary and secondary schools. Coupled with financial, socioeconomic and cultural barriers, the Social Policies and Consumer Protection EU Sub-Committee warns that the UK's future participation in mobility programmes, such as the EU's Erasmus scheme, cannot be assured. The Committee also calls on the Government to ensure the continuation of the domestic Erasmus fee waiver scheme and support the proposed development of the EU Masters-level student loan guarantee facility. Both of these measures will help more students, and those who are disadvantaged in particular. Other recommendations made by the Committee include: encouraging the Government and universities to take full advantage of the opportunities provided through engagement with the EU and Bologna Process, including greater university-business collaboration and widening participation; allocating a bigger proportion of EU funds to research, innovation and education in order to assist the EU's long-term economic recovery; encouraging the Government to "remain vigilant" about retaining the UK's higher education sector's competitive position as a destination of choice for many students from other parts of Europe and beyond, particularly following the increase in tuition fees; and not making the Commission's proposal for the introduction of the new university ranking system, U-Multirank, a priority.

Book excerpt: In this consultation paper, the Law Commissions of England and Wales, Scotland and Northern Ireland are seeking views on the regulation of health care professionals in the UK and social workers in England. In their first joint consultation, the Commissions are asking how a new legal framework would: give the regulators increased flexibility in the use of their powers while ensuring public accountability; enable them to ensure proper standards of professional education, conduct and practice; and have at its heart a duty on the regulators to protect the public. It makes provisional proposals which seek to simplify and modernise the law and establish a streamlined, transparent and responsive system of regulation of health care professionals, and in England only, the regulation of social workers

Available in PDF, EPUB and Kindle. Book excerpt: Professional services are a key component of the EU internal market economy yet also significantly challenge the legal framework governing this internal market. Indeed, specific professional regulatory structures, which are often the result of a blend of government and self-regulation, hold clear potential for conflict with EU free movement and competition law rules. Hence this book looks at the manner in which both free movement and competition laws might apply to such self- and co-regulatory set-ups, and at the leeway given to quality considerations (apparently) conflicting with free movement or competition objectives. In addition, since court action will seldom suffice to genuinely integrate a market, the book also explores those instruments of EU secondary legislation that are likely to impact the most on the provision of professional services. However, the book goes beyond a mere inventory to ask how EU Internal Market policy could contribute to the optimal legal environment for professional services. A law and economics analysis is employed to investigate the need for specific professional rules, the preferred type of regulator (self-, co- or government regulation), and the level - national and/or European - at which regulation should be adopted. As becomes clear, the story of the market for professional services is one of market and government failure; the author is thus left to compare imperfect situations where market failures compete with rent-seeking efforts, the tendency towards over-centralisation and national protectionism. This book offers both an in-depth legal analysis of the EU framework as it applies to professional services as well as a more normative evaluation of this framework based on insights from law and economics scholarship. It will therefore be a valuable resource for all practitioners, policy-makers and academics dealing with professional services, as well as, more generally, with questions of quality and self-regulation.

Leading authors in the emergent field explain the interactions and implications of EU health law through thematic reinterpretation of the law in context in key substantive areas, such as the regulation of health research, access of patients to high quality care, health care professional regulation, organisation and funding of health care services, and public health. This book offers a fresh perspective and thorough understanding of EU health law through individual and collective or systemic perspectives, and covers health law both within the EU and globally. Essential reading for anyone interested in health law in any EU Member State or in global health law.

Book excerpt: The key finding of this report is that the Mutual Recognition of Professional Qualifications Directive, which governs the mobility of healthcare professionals within the EU and is currently under review, strikes the wrong balance between allowing healthcare professionals to work in other EU countries and ensuring the safety of patients. The rules pose an unacceptable risk to the safety of patients. The Committee recommends that: regulatory bodies (including the General Medical Council, Nursing and Midwifery Council, General Dental Council and General Pharmaceutical Council) should be allowed to test the language skills of all non-UK applicants; an alert mechanism should be implemented so that authorities can share fitness to practice information and warn each other about practitioners who have been subject to disciplinary proceedings; the list of qualifications and skills recognised by the EU Directive must be updated.

Book excerpt: This book analyses European higher education policies and their three main drivers: the European Commission, the European Court of Justice and the building of the European Higher Education Area through the Bologna Process. Central to the volume is the issue of European institutions’ intervention in higher education: building a common area for higher education in a domain protected by subsidiarity is no easy task, and one that must consider the supra-national, national and institutional levels that all play a role in policy implementation. In this volume, the editors and contributors navigate within the tensions between the establishment of an internal market on the one hand and national sovereignty on the other. This volume will surely be of interest and value to those studying and working in the area of higher education policy and understanding relationships between European institutions and member states.

Available in PDF, EPUB and Kindle. Book excerpt: Sandwiched between the US - the sole superpower at the turn of the millennium - and China as the expected next superpower, Europe is rarely discussed as a potential dealer of the 21st century. At best, it is seen as an able follower of trends set by others. At worst, it is regarded as a relic; a kind of vast open-air museum with a rich culture and good food, immersed in a glorious past with limited prospects. Europe's Hidden Potential explores how an 'overlooked and underrated' continent can harness its potential to positively shape the global and economic future. As the world is looking for an alternative leader, this book shows how Europe can - and ought to - lead the way once more.

Book excerpt: In healthcare, the realisation of an optimistic prognosis against pessimistic ones depends on current innovations in diagnostic and cost-effective treatment approaches being widely adopted in clinical practice. Utilisation of advanced early and predictive diagnostics, targeted prevention and personalised medical approaches could enable the elderly subpopulation to reach the 100-year age limit in good physical and mental health, as actively contributing members of society. This task requires intelligent political regulations and creation of new guidelines to advance current healthcare systems. In this book, we will collect contributions from several geopolitical regions of Europe, Asia and USA that provide expert opinion on healthcare organisation and outlook as well as economical aspects of personalised medicine.

Book excerpt: Democratic states guarantee free movement within their territory to all citizens, as a core right of citizenship. Similarly, the European Union guarantees EU citizens and members of their families the right to live and the right to work anywhere within EU territory. Such rights reflect the project of equality and undifferentiated individual rights for all who have the status of citizen, but they are not uncontested. Despite citizenship's promise of equality, barriers, incentives, and disincentives to free movement make some citizens more equal than others. This book challenges the normal way of thinking about freedom of movement by identifying the tensions between the formal ideals that governments, laws, and constitutions expound and actual practices, which fall short. "Individual states and the European Union have either created or permitted the creation of direct and indirect barriers to mobility that undermine the promise of freedom of movement. The volume identifies these barriers, explains why they have arisen, discusses why they are difficult to remove, and explores their consequences." -- Joseph Carens, University of Toronto.
