Available in PDF, EPUB and Kindle. Book excerpt: What does it mean for courts and other legal institutions to be culturally sensitive? What are the institutional implications and consequences of such an aspiration? To what extent is legal discourse capable of accommodating multiple cultural narratives without losing its claim to normative specificity? And how are we to understand meetings of law and culture in the context of formal and informal legal processes, when demands are made to accommodate cultural difference? The encounter of law and culture is a polycentric relation, but these questions draw our attention to law and legal institutions as one site of encounter warranting further investigation, to map out the place of culture in the domains of law by relying on the insights of law, anthropology, politics, and philosophy. Culture in the Domains of Law seeks to examine and answer these questions, resulting in a richer outlook on both law and culture.

Anand, Professor at the Jawaharlal University of New Delhi, points out in the introduction of his course that the principle of sovereign equality of States refers to two twin principles which are accepted as unimpeachable norms of modern international law which cannot be questioned: the principles of equality and of sovereignty of States. Taking this as his starting point, the author first discusses the sovereignty of States in an interdependent world. He then examines the principle of equality of States in an unequal world from a historical perspective. Finally, Professor Anand tackles the questions of equality of States in a hierarchical world order, and mini-States and equality of rights. La Méthode de la Référence à l'Ordre juridique compétent en Droit international privé, Paolo Picone Paolo Picone, Professor at the University of Naples, notes in the introduction to his course that contemporary international law, such as it evolved during the 19th century, developed different methods of coordination. One method has nevertheless been neglected, which consist in choosing not the applicable law, but the competent legal system. After discussing the crisis in private international law, the author examines the method of coordination of legal systems based on the applicable law, followed by one that is based on reference to the @@@competent legal system. @@@He describes the functioning of the latter method in the case of the creation of legal situations in the @@@for, and in the case of recognition of foreign legal situations in the for. Professor Picone finishes his course by investigating the use of this method in solving the problem of preliminary matters in private international law, the method's area of application and its future prospects.

Available in PDF, EPUB and Kindle. Book excerpt: In 1763 King George III of Great Britain, victorious in the Seven Years War with France, issued a proclamation to organize the governance of territory newly acquired by the Crown in North America and the Caribbean. The proclamation reserved land west of the Appalachian Mountains for Indians, and required the Crown to purchase Indian land through treaties, negotiated without coercion and in public, before issuing rights to newcomers to use and settle on the land. Marking its 250th anniversary Keeping Promises shows how central the application of the Proclamation is to the many treaties that followed it and the settlement and development of Canada. Promises have been made to Aboriginal peoples in historic treaties from the late eighteenth to the early twentieth centuries in Ontario, the Prairies, and the Mackenzie Valley, and in modern treaties from the 1970s onward, primarily in the North. In this collection, essays by historians, lawyers, treaty negotiators, and Aboriginal leaders explore how and how well these treaties are executed. Addresses by the governor general of Canada and the federal minister of Aboriginal Affairs and Northern Development are also included. In 2003 Aboriginal leaders formed the Land Claims Agreements Coalition to make sure that treaties – building blocks of Canada – are fully implemented. Unique in breadth and scope, Keeping Promises is a testament to the research, advocacy, solidarity, and accomplishments of this coalition and those holding the Crown to its commitments.

Book excerpt: This book presents innovative insights into the intersections between science, technology, and society, and particularly their regulation by the law. Departing from the idea that law and science have similar methods and objectives, the book deals with problems, and solutions, that source from these interactions: concerns on how to integrate scientific evidence into trials, how to best regulate new technologies, or whether technological innovations could improve democratic legitimacy, create new regulatory tools or even new spaces of regulation, and what is the impact on the society. The edited collection, by building on a functionalist and comparatist approach, offers answers to how to best integrate law, science, and technology in policy-making and reviews the current attempts made at the transnational and international levels. Case studies, ranging from emerging technologies via environmental protection to statistics, are complemented by a solid theoretical framework, all of which seek to provide readers with tools for critical thinking in the reassessment of the relationship among theory, practice, political goals, and international regulation.

Available in PDF, EPUB and Kindle.

Book excerpt: This volume presents a wide selection of studies on the issues of law, land dispute and conflict (mediation) in Africa, reconsidering the role of state agents and other actors in these matters. The focus is on analyzing how citizens, state institutions and concerned (inter)national actors aim to find solutions to disputes, tension and conflict that are part of social life. The authors have approached the subject of Land, Law and Politics in Africa from a variety of disciplinary angles. The issues at stake comprise land access and land use, state politics and democratization efforts, the relationship between constitutional/state law and customary law, the challenges of urban and rural conflicts, border issues and the conceptions of (human) rights. On the basis of new empirical studies, the authors plead for a more holistic perspective on the above issues and on developmental policy in general. The book has 15 chapters in four thematic parts, focusing on historical and cultural aspects of politics and authority; land law and land disputes; constitutionalism and politics; and conflict studies. The volume is also a tribute to the work of Gerti Hesseling (1946-2009), a Dutch Africanist with a successful career as a scholar of constitutional and land law, focusing on West Africa.
