Ein Satz, den ich erst vor kurzer Zeit gehört habe und über den ich erst einmal nachdenken musste. Der Islam steht seit dem 11. September 2001 unter dem Generalverdacht, fundamentalistisch und menschenverachtend zu sein. Ebenso werden heutzutage islamische Länder verdächtigt, die Menschenrechte generell zu missachten. Muslimische Fundamentalisten relativieren solche Vorwürfe mit dem Argument, auch in den westlichen Demokratien würden die Menschenrechte allenfalls teilweise durchgesetzt, und außerdem gehörten die meisten islamischen Länder einem anderen Kulturkreis mit einer eigenen Geschichte und Tradition an. Passen Islam und Menschenrechte tatsächlich nicht zusammen ? Das Ziel dieser Arbeit ist es, zu ergründen, inwiefern sich Islam und Menschenrechte gegenseitig ausschließen. Zunächst möchte ich dazu die Entstehung und den kulturellen Kontext der Menschenrechte skizzieren. Anschließend wende ich mich dem Islam und seinen verschiedenen Erscheinungsformen zu, um schließlich die möglichen Konfliktfelder unter Berücksichtigung der gewonnenen Erkenntnissen zu analysieren. Der Ansatz der vorliegenden Arbeit ist rein theoretischer Natur, und zwar aus zwei Gründen. Zunächst einmal ist es unmöglich, im vorgegebenen Rahmen eine Fallstudie eines oder auch mehrerer islamischer Staaten zu erstellen; Weiterhin können Verletzungen der Menschenrechte in islamischen Ländern eben auch nichtislamische Gründe haben. Gerade aber diese Fälle, ebenso wie diejenigen Staaten, in denen Menschenrechte aus islamischen wie auch nichtislamischen Motiven verletzt werden, würden das zentrale Erkenntnisinteresse der vorliegenden Arbeit, nämlich die Vereinbarkeit von Islam und Menschenrechten, unzulässig verfälschen. Im 3. Kapitel beschreibe ich die unterschiedlichen Definitionen der Menschenrechte. Im 4. und 5. Kapitel werden nach einem historischen Rückblick auf den Islam und die Schari’at die Argumente oder Gegenargumente der westlichen und islamisch geprägten Länder zur Universalität der Menschenrechte dargestellt. Es geht mir dabei nicht darum, die bestehenden Theorien zu verifizieren oder zu falsifizieren, sondern die verschiedenen Argumentationen über islamische und internationale Menschenrechte anzuschauen, kritisch zu diskutieren und im 6. Kapitel in einem Dialogkonsens zusammenzuführen. Mein Ziel ist es, die Rolle der Schari’at für die Durchsetzung der Menschenrechte und deren Folgen für den Dialogkonsens zu erkennen.
