Book excerpt: After the American Revolution, the new republic's most prominent physicians envisioned a society in which doctors, lawyers, and the state might work together to ensure public well-being and a high standard of justice. But as James C. Mohr reveals in Doctors and the Law, what appeared to be fertile ground for cooperative civic service soon became a battlefield, as the relationship between doctors and the legal system became increasingly adversarial. Mohr provides a graceful and lucid account of this prfound shift from civic republicanism to marketplace professionalism. He shows how, by 1900, doctors and lawyers were at each other's throats, medical jurisprudence had disappeared as a serious field of study for American physicians, the subject of insanity had become a legal nightmare, expert medical witnesses had become costly and often counterproductive, and an ever-increasing number of malpractice suits had intensified physicians' aversion to the courts. In short, the system we have taken largely for granted throughout the twentieth century had been established. Doctors and the Law is a penetrating look at the origins of our inherited medico-legal system.

Book excerpt: The Nazi Viewpoint on the Position and Responsibilities of the Physician in the German National Socialist Society. This work is translated, annotated and introduced by Melvin Wayne Cooper. This is the first translation in English of Rudolf Ramm’s textbook Ärztliche Rechts- und Standeskunde: Der Arzt als Gesundheitserzieher, translated and introduced by Melvin Wayne Cooper. Medical Jurisprudence and Rules of the Medical Profession has been reported to be an influential manual for medical ethics in Nazi Germany and is commonly quoted as representing the Nazi viewpoint of the position and responsibilities of the physician in the National Socialist society. It interprets the National Socialist Weltanschauung, i.e. the National Socialist Philosophical Worldview, and makes explicit how this world view was to be actuated by the true National Socialist physician. It is a good text to attempt to see the National Socialist medical world view from the perspective of its practitioners. Ramm’s text could be viewed as being analogous to an Army Field Manual for the practicing National Socialist physician. It dictates the specific applications of the legal values and rules which emanate from this Weltanschauung to the developing medical students and practicing National Socialist physicians. According to some scholars Ramm’s book, which was written not only for students but also for postgraduates, and which received positive reviews in German medical journals, is the most important known historical source pertaining to the instruction of Nazi medical ethics. The 1942 edition sold out within a year, and a second edition published in 1943 included an extended appendix of medical laws. Through this book Ramm’s unique text is now available for an English language audience, thanks to the thorough translation and accessible introduction by Melvin Wayne Cooper.

Book excerpt: Jurisprudence Cases and Materials begins with two chapters on the ancient Near Eastern, biblical, and classical origins of law and jurisprudence. It offers chapters that trace the systematic development of the Anglo-American analytic canon and modern critical responses. It also analyzes jurisprudence in the courts. The result is a book that attains unusual breadth and richness of treatment of the web of law and philosophy. The book uses cases to make jurisprudence more meaningful to students and to explore the "relevance" of jurisprudence, exploring how jurisprudential assumptions implicitly or subconsciously dominate the thinking of jurists and therefore play a role in driving the law. Jurisprudence is at the very heart of law and the book tries to make that clear. Having in mind the different ways that people like to teach jurisprudence, the authors sought to design a flexible book. Students can be taken sequentially through the ancient Near Eastern, Biblical, and Classical origins of law and jurisprudence, the Anglo-American canon, modern critical responses, and how it is all reflected in the courts. The book can be taught sequentially or topically. Materials are provided which can be combined in a rich variety of ways to suit the professor's preference. The authors provide suggestions from their experience of different ways to structure the course from the materials.

Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Medical Jurisprudence Perhaps the early demand for a new American edition of Taylor's classical medical jurisprudence may in some measure be attrib ntable to the new features added at the time of the preceding Ameri can revision. The work was then brought thoroughly to date, and the law and judicial decisions both in Great Britain and the United States were introduced, together with a tabulation of cases and a reference to authorities. These changes made the work more serviceable to all classes in the two professions which it joins, increasing its hold as a favorite text-book in schools of medicine and law, rendering it even more useful to physicians in practice, and lawyers in the preparation of briefs and confirming its previous acceptance as an authority, by all English-speaking judicial tribunals. Since the issuance of the previous edition a strong impulse has been given to Forensic Medicine, by the International Congress of Medical Jurisprudence, by the Congress of Medical Jurisprudence of New York, 1895, and also by the special development of medico-legal Surgery in various societies. The present time, therefore, is most auspicious for the appearance of this new edit-ion, and it is fortunate that the demand for it comes at a time when these important advances can be represented. The increasing frequency of damage cases renders this department of medico-legal Surgery of growing importance. The eleventh American edition included the admirable work with which Dr. Thomas Stevenson had enriched the twelfth English edi tion, and was a thorough revision of all previous American and Eng lish editions. This present issue aims to continue this work along the same lines to the present date.h; The Editor desires to express his thanks and obligations to Surg Gen. George M. Sternberg, of the U. S. Army; Deputy surg.-gen. D. L. Huntington, l. D., U. S. Army; Capt. Pilcher, U. S. Army. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. Wiley to analyze the crucial role of law in addressing today's major health threats, including emerging infectious diseases, bioterrorism, natural disasters, car fatalities, gun violence, opioid overdoses, and chronic diseases caused by tobacco use, poor diet, and physical inactivity. The book creates an intellectual framework for the modern field of public health law and supports that framework with illustrations of the scientific, political, and ethical issues involved. In proposing innovative solutions for the future of the public's health, Gostin and Wiley's essential study provides a blueprint for coming public and political debates in this dynamic field. New issues covered in this edition: Corporate personhood rights raised in response to regulations of tobacco, food and beverages, alcohol, firearms, prescription drugs, and marijuana; local government authority to protect the public's health; deregulation and harm reduction as modes of public health law intervention; taxation, spending, and alteration of the socioeconomic environment as modes of public health law intervention; access to health care as a strategy for protecting the public's health; taxation, spending, licensing, zoning, and shared-use strategies for chronic disease prevention; the public health law perspective on violence and injury prevention; health justice as a framework for reducing health disparities and protecting the public's health"--Provided by publisher.
