Unlike Medicare, Medicaid will pay for long-term care, leading millions of persons in need of such care to “spend-down” income or assets to qualify as sufficiently needy or poor. However, the state can eventually seek recovery of expenditures made through estate recovery programs following the death of both spouses. As it currently stands, states have no choice but to become increasingly vigilant in pursuing private funds in order to pay for Medicaid expenditures. As a result, elderly citizens and their families will continue to face uncertainty over what will become of family assets demanded to pay for long-term care. This article examines what constitutes an “estate” for purposes of asset recovery to pay for long-term care expenditures. It also analyzes whether it is permissible for estate recovery programs to trace assets of a Medicaid recipient transferred during the recipient's lifetime, thereby depriving the Medicaid recipient or the recipient's spouse of an interest in the asset at the time of death. Finally, this article considers whether an annuity purchased to provide exempt income for a recipient's spouse should be considered a resource sufficient to disqualify an applicant from Medicaid eligibility. The article suggests that with an increase in the elderly population in need of long-term care and increased pressure on the entitlement programs that provide such care, it is crucial that Congress pass comprehensive legislation to make estate recovery programs.

Paper two examines the estate planning and wealth transfer behaviors of a cohort of older adults newly enrolled in Medicaid. Finally, paper three presents a case study of Medicaid estate recovery in North Carolina. Collectively, these three papers find that Medicaid policies that target older adults may be having disparate effects depending on socioeconomic status, race, and rurality and exacerbating disparities in intergenerational transfers of wealth while recouping little for state Medicaid programs.

Book excerpt: Pursuant to a congressional request, GAO reviewed the potential for the Department of Veterans Affairs (VA) to recoup the costs of providing nursing home and domiciliary care through an estate recovery program, focusing on: (1) the potential estimated savings; (2) program procedures that prevent undue hardships on affected veterans' family members; and (3) options for program administration. GAO found that: (1) although VA has the authority to recover unpaid nursing home copayments through estate recoveries, it does not have the same authority as states to recover the remaining costs for nursing home and domiciliary care or prevent asset transfers between veterans and family members to avoid future recovery; (2) a significant portion of VA nursing home and domiciliary care costs could be offset if VA had similar collection authority as states; (3) estate recovery programs can be structured to recover costs without placing undue hardships on the elderly, are consistent with the government's commitment to provide medical care to veterans, and can recover significantly more costs than they incur; (4) recovery of nursing home and domiciliary care costs through an estate recovery program has greater potential for veterans than for Medicaid recipients because veterans generally have greater assets and larger estates; (5) the success of the Oregon Medicaid estate recovery program should serve as a model for a VA estate recovery program; and (6) the implementation of a VA estate recovery program would not be difficult, since an administrative framework is already present and elderly advocacy groups generally accept the program because it protects recipients and their families from undue hardships.
