Book excerpt: This report provides guidance in helping police and community leaders develop successful mediation programs for addressing citizen complaints against police officers. The first chapter defines mediation as "the informal resolution of a complaint or dispute between two parties through a face-to-face meeting in which a professional mediator serves as a neutral facilitator and where both parties ultimately agree that an acceptable resolution has been reached." The goals of mediation are to achieve understanding of the issues involved in the complaint, solve any problems associated with the complaint, and achieve reconciliation between the parties. The second chapter outlines the potential benefits of mediation for police officers, citizen complainants, police accountability, community policing, the complaint process, and the criminal justice system. The third chapter discusses the key issues in developing a mediation program for citizen complaints against police. Among the issues addressed are voluntary participation, case eligibility, the mediation of racial and ethnic-related complaints, the mediation of complaints by women, potential language and cultural barriers, case screening, police discipline and accountability, and getting both sides to the table. Other issues addressed pertain to the mediation session itself and the enforcement of agreements. Chapter four presents results from a survey of existing citizen complaint mediation programs. The concluding chapter describes a model for a successful mediation program for citizen complaints against police. 100 references.

Available in PDF, EPUB and Kindle. Book excerpt: Mediating Across Difference is based on a fundamental premise: to deal adequately with conflict—and particularly with conflict stemming from cultural and other differences—requires genuine openness to different cultural practices and dialogue between different ways of knowing and being. Equally essential is a shift away from understanding cultural difference as an inevitable source of conflict, and the development of a more critical attitude toward previously under-examined Western assumptions about conflict and its resolution. To address the ensuing challenges, this book introduces and explores some of the rich insights into conflict resolution emanating from Asia and Oceania. Although often overlooked, these local traditions offer a range of useful ways of thinking about and dealing with difference and conflict in a globalizing world. To bring these traditions into exchange with mainstream Western conflict resolution, the editors present the results of collaborative work between experienced scholars and culturally knowledgeable practitioners from numerous parts of Asia and Oceania. The result is a series of interventions that challenge conventional Western notions of conflict resolution and provide academics, policy makers, diplomats, mediators, and local conflict workers with new possibilities to approach, prevent, and resolve conflict. Book excerpt: Mediation Ethics is a groundbreaking text that offers conflict resolution professionals a much-needed resource for traversing the often disorienting landscape of ethical decision making. Edited by mediation expert Ellen Waldman, the book is filled with illustrative case studies and authoritative commentaries by mediation specialists that offer insight for handling ethical challenges with clarity and deliberateness. Waldman begins with an introductory discussion on mediation's underlying values, its regulatory codes, and emerging models of practice. Subsequent chapters treat ethical dilemmas known to vex even the most experienced practitioner: power imbalance, conflicts of interest, confidentiality, attorney misconduct, cross-cultural conflict, and more. In each chapter, Waldman analyzes the competing values at stake and introduces a challenging case, which is followed by commentaries by leading mediation scholars who discuss how they would handle the case and why. Waldman concludes each chapter with a synthesis that interprets the commentators' points of agreement and explains how different operating premises lead to different visions of what an ethical mediator should do in a given case setting. Evaluative, facilitative, narrative, and transformative mediators are all represented. Together, the commentaries showcase the vast diversity that characterizes the field today and reveal the link between mediator philosophy, method, and process of ethical deliberation. Available in PDF, EPUB and Kindle. Book excerpt: In its first edition, Global Trends in Mediation was the first book to concentrate on mediation from a comparative perspective - reaching beyond the all-too-familiar Anglo-American view - and as such has enjoyed wide practical use among alternative dispute resolution (ADR) practitioners worldwide. This new edition has not only been updated throughout; it has also added two new jurisdictions (France and Quebec) and a very useful comparative table summarising the salient points from each of the fourteen jurisdictional chapters. Each jurisdictional chapter addresses critical structural and process issues in alternative dispute resolution such as the institutionalisation of mediation, mediation case law and legislation, the range and nature of disputes where mediation is utilised, court-related mediation, mediation practice standards, education, training and accreditation of mediators, the role of lawyers in mediation, online dispute resolution and future trends. All the contributors are senior dispute resolution academics or practitioners with vast knowledge and experience of dispute resolution developments in their countries and abroad.

A number of justice questions are raised to evaluate whether mediation can deliver social, distributive, procedural, or substantive justice and fairness. Focussing on a scrutiny of mediation in the context of justice, the book covers social justice and justice issues posed by confidentiality, bias, lack of fairness, and Online Dispute Resolution. Discussing whether mediation can truly deliver justice to all, this book identifies areas where this fails and provides solutions and suggestions for improvement.. The dangers of private justice, bias, mandatory mediation, and the side lining of the importance of fairness in the resolution of disputes are all considered. In contrast, the positive aspects of mediation are added to the balance. This book will be of interest to researchers in the field of conflict resolution, law, and social science. Readers will also be found among mediators and people interested in justice and the civil justice system.
