Available in PDF, EPUB and Kindle. Book excerpt: Media Law for Producers is a comprehensive handbook that explains, in lay terms, the myriad legal issues that the producer will face on a regular basis - contracts, permits, defamation, patents, releases and insurance, libel, royalties and residuals, as well as protecting the finished production. This revised and expanded edition includes such Internet-related topics as Internet music law, online registration, and online privacy. Other new topics covered include: · Implied and express contracts in the project/idea submission process · Assignment/transfer of copyright · Music clip licensing · Use of other people's trademarks in media production · Parody as a defense to copyright infringement Clear explanations examine the how and why of different types of production contracts, and checklists provide a quick means for producers to determine when their productions might be at greatest risk to legal challenges. Media Law for Producers also examines the substantial changes in copyright term resulting from recent copyright legislation. Legal problems can be very costly to media producers. Lawyers and court fees, coupled with the loss of work time, can lead to bankruptcy. Media Law for Producers cuts through the legalese and illustrates legal issues to help producers recognize the legal questions that can arise during production.

Available in PDF, EPUB and Kindle. Book excerpt: When you visit a website, check your email, or download music, you enter into a contract that you probably don't know exists. "Wrap contracts" - shrinkwrap, clickwrap and browsewrap agreements - are non-traditional contracts that look nothing like legal documents. Contrary to what courts have held, they are not "just like" other standard form contracts, and consumers do not perceive them the same way. Wrap contract terms are more aggressive and permit dubious business practices, such as the collection of personal information and the appropriation of user-created content. In digital form, wrap contracts are weightless and cheap to reproduce. Given their low cost and flexible form, businesses engage in "contracting mania" where they use wrap contracts excessively and in a wide variety of contexts. Courts impose a duty to read upon consumers but don't impose a duty upon businesses to make contracts easy to read. The result is that consumers are subjected to onerous legalese for nearly every online interaction. In Wrap Contracts: Foundations and Ramifications, Nancy Kim explains why wrap contracts were created, how they have developed, and what this means for society. She explains how businesses and existing law unfairly burden users and create a coercive contracting environment that forces users to "accept" in order to participate in modern life. Kim's central thesis is that how a contract is presented affects and reveals the intent of the parties. She proposes doctrinal solutions - such as the duty to draft reasonably, specific assent, and a reconceptualization of unconscionability - which fairly balance the burden of wrap contracts between businesses and consumers.

Book excerpt: The federal goernment contracts with public relations firms, advertising agencies, media organizations, and individual members of the media to provide, among other things, messages about its programs and services. As we have reported, there is a lack of accurate governmentwide information on these contracts. Seven federal departments account for nearly all the obligated federal dollars for public relations and advertising activities in fiscal year 2003-Commerce, Defense, Health and Human Services, Homeland Security, Interior, Treasury, and Veterans Affairs. GAO submitted a questionnaire to each of these seven departments to obtain information for fiscal year 2003 through the second quarter of fiscal year 2005 on (1) the number of contracts with public relations firms, advertising agencies, media organizations, and individual members of the media for which obligations have been incurred; (2) the total amount of contract obligations incurred on each contract by fiscal year(3) the method by which the contract was awarded-competed, noncompeted, follow-on to competed action, or not available

Entertainment attorneys and Hollywood insiders Dina Appleton and Daniel Yankelevits explain the negotiation techniques and strategies of entertainment dealmaking and detail the interests and roles of producers, writers, actors, directors, agents, and studio employees in crafting a deal. This new edition captures the dramatic changes over the past five years in the film and television industry landscape, with two new chapters: "Reality Television" details the sources of revenue, syndication possibilities, and format sales of these shows as well as the talent deals that are made, and the "Internet/New Media" chapter delves into new digital formats such as mobile phones, game consoles, video-on-demand, and web-based apps, and explains where today's revenues are generated, where the industry is headed, and talent negotiation issues. All the ins and outs of negotiating are explained, including back ends, gross and adjusted gross profits, deferments, box office bonuses, copyrights, and much more. This easy-to-follow reference is packed with expert insights on distribution, licensing, and merchandising.
