Book Synopsis Privacy and injunctions by : Great Britain: Parliament: Joint Committee on Privacy and Injunctions
Download or read book Privacy and injunctions written by Great Britain: Parliament: Joint Committee on Privacy and Injunctions and published by The Stationery Office. This book was released on 2012-03-27 with total page 108 pages. Available in PDF, EPUB and Kindle. Book excerpt: This report says Parliament should not introduce any new privacy statute. It concludes that in weighing the competing rights to privacy and freedom of expression, each case must be judged on its own merits. The bar for limiting freedom of expression must be set high, but the courts are now striking a better balance in dealing with applications for privacy injunctions. Criticism that privacy law has been "judge-made", noting that it evolved from the Human Rights Act is rejected. The Committee says the most important step towards improving protection of privacy is to provide for enhanced regulation of the media. The Press Complaints Commission lacked the power, sanctions or independence to be truly effective. Substantial changes to press regulation are needed to ensure that it encompasses all major news publishers including, in time, major bloggers. The Committee makes several recommendations including that the reformed regulator should: have access to a wider range of sanctions, including the power to fine; be cost-free to complainants; be able to determine the size and location of a published apology, and the date of publication; play a greater role in arbitrating and mediating privacy disputes. One possible mechanism the Committee suggests is for advertisers to agree to advertise only in publications that are members of the press regulator and subscribe to its rules. It also concludes that parliamentarians should ensure that material subject to an injunction is only revealed in Parliament when there is good reason to do so

Book Synopsis The Rosemary Nelson Inquiry Report by : Rosemary Nelson Inquiry
Download or read book The Rosemary Nelson Inquiry Report written by Rosemary Nelson Inquiry and published by The Stationery Office. This book was released on 2011 with total page 514 pages. Available in PDF, EPUB and Kindle. Book excerpt: Rosemary Nelson, a solicitor in Lurgan, Northern Ireland, was murdered by a bomb exploding under her car near her home in March 1999. There were claims the police and government ignored a series of warnings about threats against her: concerns about her safety had been raised over a two-year period before she was killed. She had become a hate figure for hardline loyalists - and reportedly some police officers - because of some of the Republican clients she represented. It was claimed she had been threatened by RUC officers as well as loyalist paramilitaries. The Cory Collusion Inquiry (2004, ISBN 9780102927443) investigated the allegations of collusion between British security forces and paramilitaries in her murder, and concluded that there was enough evidence to warrant a full public inquiry. This Inquiry finds no evidence of any act by or within any of the state agencies (Royal Ulster Constabulary, the Northern Ireland Office or the Security Service) which directly facilitated the murder. Some members of the RUC did publicly abuse and assault her in 1997, and make abusive/threatening remarks about her to her clients, which became publicly known. Combined with intelligence leaks these had the effect of legitimising her as a target. There were omissions by the RUC and NIO which rendered her more at risk and more vulnerable. These omissions meant the state failed to take reasonable and proportionate steps to safeguard the life of Rosemary Nelson. The Inquiry finds no evidence of obstruction into the murder investigation, which was carried out with due diligence.

Book Synopsis Parliamentary privilege by : Great Britain: Office of the Leader of the House of Commons
Download or read book Parliamentary privilege written by Great Britain: Office of the Leader of the House of Commons and published by The Stationery Office. This book was released on 2012-04-26 with total page 92 pages. Available in PDF, EPUB and Kindle. Book excerpt: Parliamentary privilege ensures that Members of Parliament are able to speak freely in debates, and protects Parliament's internal affairs from interference from the courts. Following (failed) attempts by some MPs to use parliamentary privilege to avoid prosecution for expenses fraud, the Government felt the time was right for a comprehensive review of the privileges of Parliament. Freedom of speech is arguably the most important privilege: a member must be able to speak or raise a matter without fear of a criminal or civil liability. The Government does not feel it necessary to change the protection of privilege in civil cases, nor in relation to injunctions or super-injunctions. But it is open to question whether parliamentary privilege should ever prevent members being successfully prosecuted for criminal offences. The paper consults on whether privilege should be disapplied in cases of alleged criminality, though not in respect of speeches in Parliament. The second major privilege is that of exclusive cognisance: the right of each House to regulate its own proceedings and internal affairs without interference from any outside body including the courts. This includes the conduct of its Members, and of other participants such as witnesses before select committees. Recent court judgments make clear that statute law on employment, health and safety etc do apply to Parliament providing the law would not interfere with Parliament's core functions. The green paper also consults on extending and strengthening select committee powers. A final section covers other miscellaneous privileges.

This book was released on 2012-11-19 with total page 300 pages. Available in PDF, EPUB and Kindle. Book excerpt: 'State sovereignty' is often referred to as an obstacle to criminal justice for core international crimes by members of the international criminal justice movement. The exercise of State sovereignty is seen as a shield against effective implementation of such crimes. But it is sovereign States that create and become parties to international criminal law treaties and jurisdictions. They are the principal enforcers of criminal responsibility for international crimes, as reaffirmed by the complementarity principle on which the International Criminal Court (ICC) is based. Criminal justice for atrocities depends entirely on the ability of States to act. This volume revisits the relationship between State sovereignty and international criminal law along three main lines of inquiry. First, it considers the immunity of State officials from the exercise of foreign or international criminal jurisdiction. Secondly, with the closing down of the ad hoc international criminal tribunals, attention shifts to the exercise of national jurisdiction over core international crimes, making the scope of universal jurisdiction more relevant to perceptions of State sovereignty. Thirdly, could the amendments to the ICC Statute on the crime of aggression exacerbate tensions between the interests of State sovereignty and accountability? The book contains contributions by prominent international lawyers including Professor Christian Tomuschat, Judge Erkki Kourula, Judge LIU Daqun, Ambassador WANG Houli, Dr. ZHOU Lulu, Professor Claus Kre, Professor MA Chengyuan, Professor JIA Bingbing, Professor ZHU Lijiang and Mr. GUO Yang.
