Book excerpt: Section 6603 of the Intelligence Reform and Terrorism Prevention Act of 2004 (IRTPA) temporarily amended two federal terrorist assistance prohibitions. Those amendments expire on December 31, 2006, P.L. 108-458, 118 Stat. 3762-764 (2004). Under the provisions of H.R. 3199, as passed by the House, and S. 1389, as passed by the Senate, the amendments would become permanent. In response to court decisions that found certain of their central terms unconstitutionally vague, section 6603 amended the federal statutes that outlaw assistance to terrorists and foreign terrorist organizations, 18 U.S.C. 2339A, 2339B. Initial judicial reaction suggests they may still be considered vague. Section 6603 temporarily rejected a narrow construction of the knowledge requirements under section 2339B, an interpretation which might have dissipated any vagueness problems. Section 6603 expanded the overseas application of section 2339B as well. It permits federal prosecution of an act proscribed in section 2339B and committed entirely abroad by a foreign national if the offender can be brought to this country for trial. Section 2339A outlaws providing material support or resources with the intent that they be used for the commission of certain predicate terrorism offenses. Section 6603 enlarged the list of predicate offenses to include any federal crime of terrorism (18 U.S.C. 2332b(g)(5)(B)) and added two crimes to the list, 18 U.S.C. 1361 (destruction of federal property) and 18 U.S.C. 2156 (production of defective national defense material). Finally, section 6603 added an immunity provision under which an individual or entity who provides assistance in violation of section 2339B may not be prosecuted in certain instances if the offense was committed with the prior approval of the Secretary of State and the Attorney General.

Those amendments were to expire on December 31, 2006, P.L. 108-458, 118 Stat. 3762-764 (2004). P.L. 109-160 extended their expiration date until February 3, 2006, 119 Stat. 2957 (2005); P.L. 109-170 extended it yet again until March 10, 2006, 120 Stat. 3 (2006). Section 104 of the USA PATRIOT Improvement and Reauthorization Act and Terrorism Prevention Reauthorization Act (H.R. 3199), made the amendments permanent, P.L. 109-177, 120 Stat. 195 (2006). In their present form the amendments, found in section 6603 of the act: (1) amend the definitions of "material support or resources," "training," and "expert advice or assistance" as those terms are used in 18 U.S.C. 2339A and 2339B, and of "personnel" as used in section 2339B; (2) add a more explicit knowledge requirement to section 2339B; (3) expand the extraterritorial jurisdiction reach of section 2339B; (4) enlarge the list of federal crimes of terrorism, 18 U.S.C. 2332b(g)(5); (5) add the enlarged list to the inventory of predicate offenses for 18 U.S.C. 2339A (material support for the commission of certain terrorist crimes) and consequently for 18 U.S.C. 2339B (material support for designated terrorist organizations); and (6) preclude prosecution for certain violations committed with the approval of the Secretary of State and concurrence of the Attorney General (e.g., stings). This is an abbreviated version of CRS Report RL33035, Material Support of Terrorists and Foreign Terrorist Organizations: Sunset Amendments, without the footnotes, appendix, and some of the citations to authority found in the longer, parent report.

Book excerpt: This report seeks to better understand why the Islamic State of Iraq and the Levant (ISIL) has been more successful than its predecessor organization, al Qaeda, in recruiting individuals within the United States. The authors consider whether the demographic profile of individuals drawn to foreign terrorist organizations (FTOs) has changed over time or whether new groups are more successful appealing to the same segment of the population. They take an expansive approach, analyzing all known cases of U.S. citizens or persons within the United States connected to a FTO with Islamist orientation since September 11, 2001, and use consistent criteria for inclusion and exclusion to identify individuals meeting this definition, and coding multiple demographic variables. They then conduct a quantitative analysis of the entire population, as well as the population broken down by group and by role (i.e., foreign fighters, homegrown violent extremists, etc.). Their findings reveal that the number of U.S. recruits drawn to al Qaeda and its affiliate groups has declined precipitously, commensurate with the ascent of ISIL, and that the average terrorist recruited by ISIL is not only younger and less educated but more likely to be African American/black or Caucasian/white and a U.S.-born citizen. Historically, terrorist recruits were more likely immigrants of Middle Eastern descent. These findings are relevant to U.S. defense, intelligence, and law enforcement officials, as well as to civilian academic and policymaking audiences, who may be unaware of this altered demographic profile, a perception that could bias counterterrorism policy and efforts.

Terrorist groups, such as the Islamic State (IS, also referred to as ISIS or ISIL), Al Qaeda, Hamas, and Al Shabaab, use the Internet to disseminate their ideology, to recruit new members, and to take credit for attacks around the world. Several U.S. policymakers, including some Members of Congress, have expressed concern about the influence that terrorist advocacy may have upon those who view or read it. The ease with which such speech may be disseminated over the Internet, using popular social media services, has been highlighted by some observers as potentially increasing the ease by which persons who might otherwise have not been exposed to the ideology or recruitment efforts of terrorist entities may become radicalised. These concerns raise the question of whether it would be permissible for the federal government to restrict or prohibit the publication and distribution of speech that advocates the commission of terrorist acts when that speech appears on the Internet. This book discusses relevant precedent concerning the extent to which advocacy of terrorism may be restricted in a manner consistent with the First Amendments Freedom of Speech Clause. Book excerpt: The Justice Against Sponsors of Terrorism Act (JASTA) attempts to enhance the effectiveness of U.S. efforts at combatting terrorism and combatting terrorist financing by making those who provide financial support to foreign terrorist organizations liable for their conduct. JASTA essentially makes two changes to Federal law. First, it amends the Foreign Service Immunities Act to add the existing exceptions to the foreign sovereign immunity and exception for terrorist attacks that cause physical injury or death in the United States. Under current law, there appears to be some confusion or disagreement in the courts as the whether the Foreign Sovereign Immunity Acts tort exception waives the immunity of foreign governments that provide material support to foreign terrorist organizations that cause damage in the United States. JASTA makes clear that a foreign government that aids and abets a foreign terrorist organization in carrying out a terrorist attack on U.S. soil will not be immune from the jurisdiction of our court. Second, JASTA amends the Antiterrorism Act to clarify that those who aid, abet, or conspire with a foreign terrorist organization are subject to civil liability. By making these two changes to existing law, JASTA seeks to ensure that those, including foreign governments, who sponsor terrorist attacks on U.S. soil are held fully accountable for their actions.
