It is not long since her priests dare not perform a marriage between a Protestant and a Roman Catholic."* There is the cause of the agitation, people say: the memory of the days of full-blown ascendency, and madness at the thought that the Catholic Church now insists on having the marriages of Catholics in Ireland, even mixed marriages, celebrated according to general ecclesiastical law. I offer no opinion myself about the relative merits of these explanations. I prefer to treat of the doctrine and discipline of the Church in relation to Christian marriage. And it will be found that the Church's marriage doctrine is sacred and sublime, and that her discipline is not unreasonable even in cases such as the case of Mrs. McCann.

Some remissions had already been granted, but they were only local privileges, which were granted on account of special local circumstances, and which therefore could not be claimed beyond the places for which the concessions had been made. Thus the Archbishop of Paris had in 1898 (9th of November) obtained the privilege that the fact of residence for six months in a parish of the city of Paris, was sufficient for the acquisition of a quasi-domicile enabling a person to marry validly in that parish, and that there was no necessity to enquire into the intention of residing there for the greater part of a year." begins the history behind this decree.Catholic Marriage Law has varied over the centuries. A large step forward was made, when the Council of Trent published Tametsi. However, this only applied in those places where it was legally published. Thus the Church had two marriage laws in operation, depending on the domicile of the parties involved. The Vatican Council of 1869-1870 desired a codification of Canon Law, which was completed under Pope Benedict XV in 1917. Part of this led to a unification and clarification of Catholic Church Law on Matrimony, which is set out in this important landmark decree.Anyone wishing to understanding Catholic marriage law must study this decree as well as the subsequent caons of the Code of Canon Law, which evolved from it.
